Lawrence Warunge’s mental results are finally out.

Warunge, the prime suspect in the murders of four family members in Kiambu, had his results presented by a psychiatrist before a Kiambu court.

The results established that Warunge was not fit to stand trial.

The court ordered Warunge to be remanded for a further 30 days after which a second mental assessment would be undertaken.

Chief magistrate Patricia Gichohi ordered Warunge to be held in police custody in Nairobi until March 1, 2021 when the matter will be mentioned.

The suspect’s girlfriend was released after she reached a deal to become a state witness against the university student. 

Kenyan law requires that every person has a right to legal capacity which entails being in the right state of mind to understand the charges. 

Warunge and Muthoni failed to take a plea in court on Monday, January 25, as had been anticipated to allow for a mental examination to be conducted.

Last week, detectives visited the home of the slain Kiambu family with the murder suspect Warunge in a bid to reconstruct the crime scene and collect more evidence.

The officers kept journalists and the public away from the home on Monday and they could be seen carrying samples to vehicles.

After spending hours at the house, the detectives got out with a handcuffed Lawrence and bundled him into a car before speeding off.

Nicholas Warunge was killed together with his wife, two children and a construction worker.

James Mburu, a resident, said that the village is still in shock over the brutal killings.

Earlier, the DCI requested the court for 14 days to complete investigations. Kiambu Chief Magistrate Stella Atambo granted the request and set hearing on January 25.

Lawrence, a university student, went missing after the gruesome murder of his parents, brother, a nephew and a mason at their Karura home in Kiambu.

Warunge, who worked as a nurse abroad is reported to have been in the country for 10 days during festivities when the killers struck.

According to detectives, the killers made their way into the house through the rear door where they found Warunge’s wife Anne Njoroge and hacked her to death before slitting her throat.

Maxwell Njenga, 13, Warunge’s nephew who celebrated his birthday on December 26 was the second victim of the assailants who was also stabbed several times before his throat was slit.

The killers did not stop; they accosted Warunge’s son Christian Njenga in his bedroom and killed him too.

Warunge who was in his bedroom upstairs escaped through the balcony, but the attackers pursued and stabbed him 34 times before slitting his throat at near the gate.

Also killed in the same style was mason James Kinyanjui who was in the home at the time of the attack.

Homicide detectives led by Martin Nyuguto are using among other leads bare footprints left at the rear door near the spot Warunge was killed to pursue the killers.

Kapsaret Member of Parliament Oscar Sudi is not new to controversy. On several occasions, the controversial lawmaker has found himself on the wrong side of the law.

On Friday, January 22, Sudi found himself in hot soup after he decided to abscond Court.

A Nakuru court was forced to summon the DP William Ruto allied MP after he failed to show up in a hate speech case against him.

Sudi’s hate speech and offensive conduct case hearing was set to proceed today but he failed to attend court. 

Senior Assistant Director of Public Prosecution Daniel Karuri made an application for the court to order Sudi arrested. 

Karuri urged Senior Resident Magistrate Benjamin Limo to also compel the lawmaker to attend court. 

Defence counsel Felix Orege informed court that he was unwell and sought another date. 

Orege added that Sudi will avail his medical report in court during the next court appearance. 

Limo dispensed Sudi’s attendance in court on account of sickness and declined to issue an arrest warrant. 

“Instead, summons are hereby issued to the accused to attend court and avail medical documents in support of his disposition on the day he was to attend court,” ruled Limo. 

The prosecution had lined up three police officers from the National Cohesion and Integration Commission (NCIC) to testify.

Sudi is charged with two counts of hate speech and one count of offensive conduct.

The MP has denied that he used threatening words on social media, which were likely to stir up ethnic hatred on September 7, 2020, at an unknown place within the Republic of Kenya.

He has also denied offensive conduct charges and is out on Sh500,000 bail.

The case has been slated for February 19.

Alego Usonga MP Samuel Atandi is wanted by police after he allegedly beat up South East Alego Chief, Joseph Ogutu Onjala to near death.

According to the chief who is currently recuperating at a private hospital in Siaya town, Atandi and his bodyguards stormed his house on Wednesday night, January 20, and assaulted him, leaving him unconscious.

Atandi is said to have accused the chief of hiring locals to disrupt a ceremony in which he had presided over.

Earlier on Wednesday, the fiery politician had commissioned renovations of classrooms at Unna Primary school, Siaya County.

After word got around of the assault incident, angry locals pursued their MP which prompted him to seek refuge at Nyangoma police station.

While at the station, he recorded a statement alleging that his function had been disrupted by rowdy youth who wanted to harm him.

The reports were confirmed by Siaya County Commissioner Michael ole Tialal who noted that Chief Onjala’s assistant had also gone missing in mysterious circumstances.

This is not the first time the legislator is on the spot for an alleged assault case. In January 2019, reports indicated that he had allegedly assaulted a government officer.

Accompanied by a few men, Atandi reportedly stormed the County Director of Education’s office seeking the Director’s contact.

The officer present declined to give him the contact which prompted him to slap her on the face.

The Independent Electoral and Boundaries Commission (IEBC) has been thrown into deep mourning.

The commission on Thursday, January 21 confirmed that one of its staff members has been found murdered.

According to IEBC, the official identified as Brian Silale lost his life in the ongoing Kapedo attacks.

Silale, a Constituency Administrative Assistant for Tiaty Constituency Office, was among the six bodies that were found dumped in Arabal area.

“Mr Silale was last seen alive being picked by unknown person, together with five (5) other people, from Chemolingot shopping centre in Tiati Sub-County on January 19, 20201 at about 3 p.m.

“He was later murdered under unclear circumstances and the remains of his body together with other bodies were recovered on Wednesday, January 20 at Arabal Sub-location,” read the statement in part.

The IEBC called on the state to investigate the incident with immediate effect and apprehend the culprits. 

The bodies of the six individuals were found dressed in suits and neckties – a rare dressing style in a village where most residents are herders.

The are suspected to include a Human Resource Officer, a Primary School Headmaster, an MTC student and a businessman.

Tiaty MP William Kamket has been arrested over the banditry attacks in Kapedo that have left at least seven people dead so far.

The KANU lawmaker was apprehended by detectives in Nairobi County on Thursday, January 21. 

Reports stated that he was detained at Kileleshwa Police Station. 

Kamket was accused of inciting local citizens to revolt. The issue is facing a number of challenges, from land and boundary cases to civil wars among various communities. 

Interior CS Fred Matiang’i had on Tuesday, January 19, after a meeting with security officials, revealed that operations in the area would be ongoing until individuals behind attacks there were caught.

The warning came after chaos in the neighboring Kapedo, Turkana County left a police commander dead.

I believe you have come across a video that was hugely circulated online, showing boda boda operators almost lynching suspects who had robbed someone of his money in Nairobi CBD, haven’t you?

Fredric Otieno, the man who was robbed of Sh320,000 he had withdrawn from a bank in Nairobi has narrated the events that led to a dramatic chase by boda boda operators.

Speaking to a local daily, the 30-year-old Otieno said he might have been confused by ghosts.

The victim narrated that he suspects those behind the incident sprayed chemicals onto his face as they confronted him outside the bank.

Otieno believes there are more members of the group that attacked him who are on the loose. He said two women who first approached him are yet to be found or arrested.

“I did not see them in the videos that circulated as the other accomplices were almost being lynched. They are out there may be attempting a similar thing on unsuspecting Kenyans,” he said.

Otieno said he had driven with his cousin to the bank and withdrew about Sh25,000 which he wanted to send to a university in Canada for his online studies.

He told his cousin to drive on and look for parking as he transacted in the bank at about 1pm. After he finished the transactions he walked out and was confronted by two women near the entrance who first introduced themselves as Safaricom agents.

They said they were carrying out a promotion, which if he put his money would triple it.

“In the process I felt dizzy and could not remember much. I handed one woman the money I had and I walked back to the bank and withdrew Sh270,000 more. I walked back and was looking for my cousin albeit confused when a man now came and grabbed the other money and walked away,” he remembered.

After the man grabbed the money, he saw him board a black Voxy car that was later intercepted kilometres away.

He screamed for help alerting boda boda riders who were nearby.

Some of the riders had witnessed the drama and gave chase after the car as it sped off towards Haile Selassie Avenue, joined Uhuru Highway before it was intercepted at University Way roundabout.

The boda boda operators beat up the three suspects who were on board and vandalised the car. In the process, the money vanished.

It took the intervention of police officers at the roundabout to shield the three who were later rushed to the Mbagathi Hospital with multiple injuries.

The drama of their beatings was captured on camera by other motorists. The getaway vehicle whose windshields had been smashed in was towed to the Central Police station.

Otieno, a father of two children, cannot explain how the two women who first approached him knew he had withdrawn the money. 

He said he is a week old in Kenya and planned to stay for a month before going back to Qatar where he has worked for the last seven years.

He appealed to police to go to the bank and seek security footage of Tuesday’s events to identify the women who first approached him.

He added his family was shocked to learn he was robbed of the money.

Otieno said police recorded his statement soon after the incident. Police said a team of detectives is investigating if bank staff or imposters were involved in the incident.

Police believe some staffers or imposters usually sit in banking halls and monitor transactions before alerting gangs.

Such incidents have been reported in the past whereby people are robbed of money soon after withdrawing.

Nairobi police boss Rashid Yakub said they are investigating the incident. He discouraged mob lynching, terming it illegal.

Kirinyaga County Akorino pastor John Gichira, who pleaded guilty to defiling and impregnating his two daughters aged 14 and 16 years has been sentenced to 140 years in jail.

Senior Principal Magistrate Anthony Mwicigi ruled that the pastor will serve 70 years for each case, after defiling the girls.

On Thursday, January 7, the prosecution verified the girls’ birth certificate and ascertained that they were below 18 years, paving way for the magistrate to make his ruling on Thursday, January 14. 

Court documents disclosed that the suspect committed the offense on diverse dates between June 1, 2019, and June 30, 2019, and between August 1, 2020, and August 31, 2020, in Ndia Constituency.

The 51-year-old Akurino Pastor was arrested in early January 2021, after Woman Representatives Purity Ngirici (Kirinyaga) and Gladys Shollei (Uasin Gishu) led protests in Kirinyaga County.

The MPs also urged the mother of the victims to report the case to the police.

Police flushed him from a hideout in the county after tracking him down for one month.

Kirinyaga West Deputy County Commissioner, Moses Ivuto, said that he would ensure that the suspect never sets foot in the village as he was a threat to women and girls.

Just a day after a form three student was arrested for attacking and stabbing his two teachers at Kisii High School, another student has been arrested for plotting the act.

A form two student at Mokwerero secondary school was arrested for threatening a deputy Principal Jared Morara while armed with a panga and a sharpening file.

According to reports, the student threatened to slash the deputy Principal with a machete, which according to the county commissioner has not been established on how the boy made it to school with.

The principal Kennedy Ogecha called the assistant chief immediately and they rescued the deputy Principal from the boy who had vowed to eliminate him.

Nyamira County commissioner Amos Mariba has urged the school heads to ensure they do thorough frisking when students report back to school to curb such behaviours among the learners.

The incident happened at Manga Sub County Nyamira County. Investigations are ongoing as authorities hold the boy for interrogation.

Meanwhile, a 17-year-old Kisii School student on Tuesday denied attempting to kill two teachers at the institution.

The student denied the charges before Senior Resident Magistrate Onchoro when he was charged at the Kisii Law Courts.

SRM Onchoro released him on bond of Sh100, 000 or a cash bail of Sh50, 000 with surety of similar amount or be remanded at Manga Children’s Remand Home in Nyamira County as he was a student.

The student who was represented by advocate Ben Gichana was charged with attempting to kill Edward Mokaya and Elvis Maoto at the school’s staff room by stabbing them using a kitchen knife.

The prosecution led by Hillary Kaino did not oppose the release of the student.

“There is no compelling reason for us to oppose his release on bail,” Kaino told the court.  

The student was dressed in his full school uniform – a green sweater, white shirt and grey trousers and looked calm throughout the brief court appearance.

It is alleged he attacked Mokaya for punishing him for arriving to class late and Maoto for attempting to rescue his colleague who was under attack.

Mokaya who sustained four deep cuts on the head is admitted at Ram Hospital in Kisii while Maoto was treated and discharged.

The case will be mentioned on January 27 for a pre-trial.

The Name ‘Dr Mugo wa Wairimu” is no longer new to Kenyans! Or is it? James Mugo alias Mugo wa Wairimu is not a new face in the Kenyan media.

Mugo grabbed media headlines in September 2014 after a sensational video clip showing a man taking an advantage of a sedated woman at the Prestige Health Care clinic in Githurai went viral and sparked public outrage on social media.

In 2018, Mugo again hit the headlines after NTV ran an expose, unravelling the dirty businesses of the now known quack doctor.

The expose forced relevant authorities to swing into action, and Mugo was arrested.

On Wednesday October 28, 2020, Mugo was slapped with a Sh1.4 million fine, failure to which he is to spend three years in jail.

This is after he was found guilty of unlawfully operating a pharmacy business without being registered by the Pharmacy and Poisons Board.

Senior Resident Magistrate Martha Nanzushi ruled that the prosecution had proved its case against Wairimu.

He was also convicted of operating a medical laboratory without registration and licence by the Kenya Medical Laboratory Practitioners and operating an unregistered medical clinic.

Wairimu was also found guilty of practising as an unregistered and unlicensed medic.

Mugo was arrested and charged in 2015 with various offences linked to operating an illegal clinic in Githurai 44, Nairobi, and raping a sedated woman.

Mugo was also charged with operating a drug shop not registered with the Pharmacy and Poisons Board.

In 2015, the name of his clinic then was offering 24-hour health care services. The services included, bizarrely, all kinds of x-ray and ultrasound scans though he never had the equipment.

In the dubious mix were also dental surgery, major theatrical services among others.

Father John Pesa, the cleric who made headlines a few weeks ago after mistakenly claiming that King Solomon killed Goliath using a stone and sling, is in trouble following a latest court ruling.

The High Court in Kisumu has ordered Father Pesa to compensate a sick boy who was allegedly tortured at while and confinement at Father Pesa’s Holy Ghost Coptic Church of Africa headquarters in Mamboleo, Kisumu.

According to a report by The Standard, the court ordered the cleric to pay Ksh 500,000 for denying the boy suffering from an acute psychotic disorder his freedom as he was preparing to sit for his Kenya Certificate of Secondary Education (KCSE) examination in 2017.

Father Pesa together with his church are to pay the boy the cost he incurred in the case plus interest that is to be calculated at the court rate.

The boy is said to have been taken to Father Pesa in 2017 when the school noticed he had trouble concentrating on his studies and advised his parents to take him for medical treatment.

The cleric was to take the boy through spiritual healing.

However, that was not the case. Father Pesa is said to have chained the boy in his church, until May 2019 which was long after KCSE exams had been undertaken and therefore missed his studies and examination.

The boy’s parents found out when they visited him in the company of officers from the Kenya National Commission on Human Rights.

According to reports, the boy is said to have been cuffed in heavy chains and when his parents demanded for his release, Father Pesa is said to have declined to do so, forcing them to seek legal redress in a battle that has seen them in the corridors of justice since 2018.

Father Pesa had however denied the claims, arguing that there is no medical evidence to prove that the boy was tortured, but a report by a psychiatrist revealed that the boy was on treatment for acute psychotic episode.

Acute psychotic episode is an illusionary illness that can be a one-time occurrence, usually of sudden onset, or can occur repeatedly or may be the early phase of mental illness.

Former Harambee Stars head coach Jacob ‘Ghost’ Mulee has this morning been involved in a road accident in Westlands, Nairobi.

According to multiple reports, ‘Ghost’ has been rushed to Aga Khan Hospital for a check up after his car was hit by a rogue matatu along Brookside Drive, Westlands.

The famed radio presenter’s car was thrown into a City Clock after being hit.

He was on his way to work at Lion’s Place along Waiyaki Way, where the Radio Africa Group is hosted.

‘Ghost’ was rushing to do his famous show ‘Gidi na Ghost asubuhi’ that airs on Radio Jambo.

The radio show is famous across the country for its ‘Patanisho’ segment, where Ghost alongside his fellow show host Gidi Gidi, normally reconcile couples and lovers who have had some differences in their relationship.

Mulee coached Kenyan club side Tusker between 1999 and 2009, winning the Kenyan Premier League title three times. He later coached APR of Rwanda and Young Africans of Tanzania. 

He first took charge of Kenya between 2003 and 2004, including at the 2004 African Cup of Nations.

Last year, Ghost while in an interview with a local publication revealed he will be making a return to coaching in the Kenyan Premier league this season.

Mulee has been out of competitive football for about 10 years.

Should he make a return to the Kenyan Premier League, it is not yet known which side he will be taking.

He had earlier been linked with Wazito FC.

Director of Public Prosecutions Noordin Haji has approved murder charges against Malindi Member of Parliament Aisha Jumwa.

The MP found herself in trouble last year when an uncle to an Orange Democratic Movement aspirant in Ganda ward mini polls was shot dead.

She was arrested at her Kakuyuni home in Malindi after a 48-year-old man was shot in the chest and killed.

Police announced that the MP and her aide Geoffrey Okuto Otieno were under investigation for the murder of Ngumbao Jola at the homestead of Reuben Mwambire Katana, the ODM candidate for the Ganda ward by-election.

The firearm used to shoot the uncle to the then ODM candidate belonged to the lawmaker.

The cartridge of the firearm ammunition packaging is licensed to the MP.

The man was shot dead on October 15, 2019, during chaos involving the MP and Orange Democratic Movement supporters at Ganda in Kilifi county.

The incident had occurred at the Penduliani home of an ODM candidate for the Ganda ward by-election Reuben Katana. Katana and other leaders were allegedly meeting agents to prepare for the mini poll.

Jumwa and her team are reported to have forced themselves into the home following reports that a team of ODM leaders were meeting youths. Earlier, armed police officers had visited the home.

The Independent Electoral and Boundaries Commission had declared that Monday as the final day for campaigns. However, the police had later provided security after being informed that the meeting had nothing to do with campaigns.

Former Nairobi County governor Evans Kidero has been dealt a major blow in his bid to stop investigating agencies from probing how he acquired his wealth.

The Court of Appeal has declined to bar the Ethics and Anti-Corruption Commission (EACC) from probing Kidero and his wife Susan Mboya’s property and accounts in a quest to recover unexplained wealth.

Justices Roslyn Nambuye, Daniel Musinga, and Gatembu Kairu ruled that investigations and filing of an asset recovery case had not started, hence Kidero had not convinced them that barring the anti-graft watchdog from investigating his family’s wealth would be adverse.

The Kideros went to the Appeals Court after the anti-corruption court in Nairobi dismissed their case in June.

Justice Mumbi Ngugi, in her verdict, said the couple’s privacy rights had not been violated. In the case, Kidero’s wife claimed she was a woman of means and had acquired her wealth, which was distinct from what her husband has.

However, Justice Ngugi ruled that although her wealth ought to be protected, there was a need to ascertain that she did not acquire it in concert with Kidero.

In the case, the anti-graft agency claimed its investigations had revealed that Kidero had assets worth Sh9 billion.

In a reply filed before the anti-corruption court,   where Kidero is seeking orders to block investigations into his source of wealth, EACC claims it has reasonable suspicion to believe that the former governor was involved in corruption or economic crimes.

According to Mulki Abdi Umar, one of the investigators in the case, Kidero also owns 11 vehicles that include Range Rovers and Mercedes Benzes.

He, however, did not reveal how much the vehicles were worth in his reply before Justice Hedwig Ong’undi.

Investigations revealed that Kidero owns 50 rental units on Riara Road estimated at Sh1 billion and another property known as Muthaiga Heights worth the same amount.

Mr Umar said he received several complainants saying Kidero had illegally acquired wealth while he was the Mumias Sugar Company managing director and the Nairobi governor.

Politicians from both sides of the Jubilee faction in Murang’a county were involved in planning and executing chaos in Kenol town, Murang’a, on Sunday October 4, an intelligence report has revealed.

According to the report seen by a local daily, Murang’a Woman Representative Sabina Chege and former MCA Alex Mbote, who is now Governor Mwangi Wairia’s political advisor, planned the chaos.

It said Tangatanga-leaning MPs Alice Wahome (Kandara) and Ndindi Nyoro (Kiharu) mobilised youths for a counterattack.

But the politicians rubbished the claims, terming rumours and diversionary.

“Those are rumours. That day I was not even near Kenol. Anybody saying that [that I was involved] wants to soil my name,” Mbote told the the local daily when contacted.

When reached for comment, Chege said, “I am not aware.”

Nyoro termed the report petty and diversionary, adding he had provided details to police of how some county politicians planned and executed the violence.

“The state must stop playing politics. Do they think Kenyans are fools? How could we have planned to disrupt our own function? How possible is that? Or they are saying we still disrupted [the DP’s event in] Nyamira?” Nyoro asked.

Wahome did not respond to phone calls and a text message by the local daily seeking her comment on the report.

According to the report, Mbote was allegedly tasked by Chege to mobilise youths to disrupt the DP’s function.

It said Mbote planned the attack at a hotel in Thika Town. He met about 30 men, referred to as unit leaders, whom he had mobilised to execute he chaos.

“Mr Mbote, who was the ring leader, tasked each member to mobilise 10 youths for the task ahead. They took lunch and some drinks and Mr Mbote paid via pay bill number over Sh15,000,” the report reads.

Later, Mbote called Chege, who instructed that they meet at a club within Murang’a county. The woman rep was with other politicians from the county the report read.

At the meeting, Mbote demanded Sh3 million from the lawmakers but they negotiated and settled on Sh1.5 million. He drove to another club where he met another politician who gave him the cash.

On that Sunday, Mbote is said to have hired a taxi, the one he had used the day before, to Thika town where he met the 30 unit leaders – each at different times. He gave them cash for logistics and down payments.

“On October 10, 2020…. youths (goons) were ferried by several matatus from Kiandutu slums of Thika, Weitethia, Mugoiri and Kiriainito, Kenol where they alighted at Makenji area of Kabatito the venue,” the report read.

MPs Wahome and Nyoro, who had got wind of the planned chaos, according to the report, mobilised youth from Kandara and Kangema and others from Nairobi county from where they were ferried to counter Mbote’s team.

The Office of the Director of Public Prosecutions has declined to approve charges against officials implicated in the Kenya Medical Supplies Authority (KEMSA) scandal.

DPP Noordin Haaji on Friday October 2, 2020 returned the KEMSA inquiry file back to Ethics and Anti-Corruption Commission (EACC) after identifying gaps in investigations that need to be filled before he makes the decision to charge.

He directed his team of senior prosecutors appointed to review the file to conduct joint meetings with EACC to expedite the investigations.

According to a statement issued by his office, before making decision to charge, the DPP ensures there is sufficient evidence to support charges with a reasonable prospect of conviction in line with the Constitution, ODPP Act, National Prosecution Policy and Decision to Charge guidelines.

EACC officials had recommended the prosecution of six senior officials from Kemsa.

DPP Haji stated that the matter had attracted great public expectation and it was important for the team to ensure that there was sufficient evidence to support charges with a reasonable prospect of conviction.

“The constitution provides that the DPP must exercise State powers of prosecution with regard to the public interest, the interests of the administration of justice and the need to prevent and avoid abuse of the legal process,” reads the statement.

The DPP indicated that his team had identified key areas that needed to be sufficiently covered by way of further investigations before the final decision could be made.

Haji stated that his office had also not received an audit report that had been presented to the senate on September 30, 2020, by the Auditor General, Ms Nancy Gathungu.

Once the DPP received the report, he vowed that it would also be taken to consideration.

The DPP stated that the inquiry file had been returned to the EACC to cover the areas identified for further investigations.

On September 18, 2020, the DPP received an inquiry file from the EACC on the allegations of irregular procurement and fraudulent payments relating to the purchase and supply of Covid-19 emergency commodities at KEMSA which led to the irregular expenditure of public funds amounting to Ksh 7.8 billion.

Sirisia MP John Waluke

Sirisia Member of Parliament John Waluke and his co-accused Grace Wakhungu are not yet off the hook after Justice John Onyiego of the High Court on September 30 released them on cash bail.

Justice Onyiego granted Waluke and Wakhungu Sh10 million and Sh20 million bail  respectively, pending hearing and determination of their appeal.

The judge also gave them an alternative of depositing bonds of Sh20 million and Sh30 million respectively with sureties.

However, the Director of Public Prosecutions (DPP)  has moved to the Court of Appeal to challenge the release of the two on bond.

The DPP has filed a notice of appeal indicating that he is dissatisfied with the decision made by Justice John Onyiego on September 30.

“Take notice that the DPP, being dissatisfied with the decision of the High Court intends to appeal to the Court of Appeal against the decision in which the court released each of the appellants on bail pending their appeal,” reads the notice.

The notice was also served to the lawyers of the two convicts.

The two, who are also directors of Erad Supplies Ltd, were convicted in June by the Anti-Corruption Court for theft of Sh297 million from the National Cereals and Produce Board (NCPB).

The trial court also imposed a combined fine of Sh2 billion. In default, Wakhungu was handed a 39-year sentence while waluke was slapped with a 34-year sentence.

But they challenged their conviction and sentence and sought to be released on bail pending the determination of appeal.

While allowing their request, Justice Onyiego said he was persuaded that the two convicts have an arguable appeal against the lower court’s judgment.
