Director of Public Prosecutions Noordin Haji has approved murder charges against Malindi Member of Parliament Aisha Jumwa.

The MP found herself in trouble last year when an uncle to an Orange Democratic Movement aspirant in Ganda ward mini polls was shot dead.

She was arrested at her Kakuyuni home in Malindi after a 48-year-old man was shot in the chest and killed.

Police announced that the MP and her aide Geoffrey Okuto Otieno were under investigation for the murder of Ngumbao Jola at the homestead of Reuben Mwambire Katana, the ODM candidate for the Ganda ward by-election.

The firearm used to shoot the uncle to the then ODM candidate belonged to the lawmaker.

The cartridge of the firearm ammunition packaging is licensed to the MP.

The man was shot dead on October 15, 2019, during chaos involving the MP and Orange Democratic Movement supporters at Ganda in Kilifi county.

The incident had occurred at the Penduliani home of an ODM candidate for the Ganda ward by-election Reuben Katana. Katana and other leaders were allegedly meeting agents to prepare for the mini poll.

Jumwa and her team are reported to have forced themselves into the home following reports that a team of ODM leaders were meeting youths. Earlier, armed police officers had visited the home.

The Independent Electoral and Boundaries Commission had declared that Monday as the final day for campaigns. However, the police had later provided security after being informed that the meeting had nothing to do with campaigns.

Former Nairobi County governor Evans Kidero has been dealt a major blow in his bid to stop investigating agencies from probing how he acquired his wealth.

The Court of Appeal has declined to bar the Ethics and Anti-Corruption Commission (EACC) from probing Kidero and his wife Susan Mboya’s property and accounts in a quest to recover unexplained wealth.

Justices Roslyn Nambuye, Daniel Musinga, and Gatembu Kairu ruled that investigations and filing of an asset recovery case had not started, hence Kidero had not convinced them that barring the anti-graft watchdog from investigating his family’s wealth would be adverse.

The Kideros went to the Appeals Court after the anti-corruption court in Nairobi dismissed their case in June.

Justice Mumbi Ngugi, in her verdict, said the couple’s privacy rights had not been violated. In the case, Kidero’s wife claimed she was a woman of means and had acquired her wealth, which was distinct from what her husband has.

However, Justice Ngugi ruled that although her wealth ought to be protected, there was a need to ascertain that she did not acquire it in concert with Kidero.

In the case, the anti-graft agency claimed its investigations had revealed that Kidero had assets worth Sh9 billion.

In a reply filed before the anti-corruption court,   where Kidero is seeking orders to block investigations into his source of wealth, EACC claims it has reasonable suspicion to believe that the former governor was involved in corruption or economic crimes.

According to Mulki Abdi Umar, one of the investigators in the case, Kidero also owns 11 vehicles that include Range Rovers and Mercedes Benzes.

He, however, did not reveal how much the vehicles were worth in his reply before Justice Hedwig Ong’undi.

Investigations revealed that Kidero owns 50 rental units on Riara Road estimated at Sh1 billion and another property known as Muthaiga Heights worth the same amount.

Mr Umar said he received several complainants saying Kidero had illegally acquired wealth while he was the Mumias Sugar Company managing director and the Nairobi governor.

Politicians from both sides of the Jubilee faction in Murang’a county were involved in planning and executing chaos in Kenol town, Murang’a, on Sunday October 4, an intelligence report has revealed.

According to the report seen by a local daily, Murang’a Woman Representative Sabina Chege and former MCA Alex Mbote, who is now Governor Mwangi Wairia’s political advisor, planned the chaos.

It said Tangatanga-leaning MPs Alice Wahome (Kandara) and Ndindi Nyoro (Kiharu) mobilised youths for a counterattack.

But the politicians rubbished the claims, terming rumours and diversionary.

“Those are rumours. That day I was not even near Kenol. Anybody saying that [that I was involved] wants to soil my name,” Mbote told the the local daily when contacted.

When reached for comment, Chege said, “I am not aware.”

Nyoro termed the report petty and diversionary, adding he had provided details to police of how some county politicians planned and executed the violence.

“The state must stop playing politics. Do they think Kenyans are fools? How could we have planned to disrupt our own function? How possible is that? Or they are saying we still disrupted [the DP’s event in] Nyamira?” Nyoro asked.

Wahome did not respond to phone calls and a text message by the local daily seeking her comment on the report.

According to the report, Mbote was allegedly tasked by Chege to mobilise youths to disrupt the DP’s function.

It said Mbote planned the attack at a hotel in Thika Town. He met about 30 men, referred to as unit leaders, whom he had mobilised to execute he chaos.

“Mr Mbote, who was the ring leader, tasked each member to mobilise 10 youths for the task ahead. They took lunch and some drinks and Mr Mbote paid via pay bill number over Sh15,000,” the report reads.

Later, Mbote called Chege, who instructed that they meet at a club within Murang’a county. The woman rep was with other politicians from the county the report read.

At the meeting, Mbote demanded Sh3 million from the lawmakers but they negotiated and settled on Sh1.5 million. He drove to another club where he met another politician who gave him the cash.

On that Sunday, Mbote is said to have hired a taxi, the one he had used the day before, to Thika town where he met the 30 unit leaders – each at different times. He gave them cash for logistics and down payments.

“On October 10, 2020…. youths (goons) were ferried by several matatus from Kiandutu slums of Thika, Weitethia, Mugoiri and Kiriainito, Kenol where they alighted at Makenji area of Kabatito the venue,” the report read.

MPs Wahome and Nyoro, who had got wind of the planned chaos, according to the report, mobilised youth from Kandara and Kangema and others from Nairobi county from where they were ferried to counter Mbote’s team.

The Office of the Director of Public Prosecutions has declined to approve charges against officials implicated in the Kenya Medical Supplies Authority (KEMSA) scandal.

DPP Noordin Haaji on Friday October 2, 2020 returned the KEMSA inquiry file back to Ethics and Anti-Corruption Commission (EACC) after identifying gaps in investigations that need to be filled before he makes the decision to charge.

He directed his team of senior prosecutors appointed to review the file to conduct joint meetings with EACC to expedite the investigations.

According to a statement issued by his office, before making decision to charge, the DPP ensures there is sufficient evidence to support charges with a reasonable prospect of conviction in line with the Constitution, ODPP Act, National Prosecution Policy and Decision to Charge guidelines.

EACC officials had recommended the prosecution of six senior officials from Kemsa.

DPP Haji stated that the matter had attracted great public expectation and it was important for the team to ensure that there was sufficient evidence to support charges with a reasonable prospect of conviction.

“The constitution provides that the DPP must exercise State powers of prosecution with regard to the public interest, the interests of the administration of justice and the need to prevent and avoid abuse of the legal process,” reads the statement.

The DPP indicated that his team had identified key areas that needed to be sufficiently covered by way of further investigations before the final decision could be made.

Haji stated that his office had also not received an audit report that had been presented to the senate on September 30, 2020, by the Auditor General, Ms Nancy Gathungu.

Once the DPP received the report, he vowed that it would also be taken to consideration.

The DPP stated that the inquiry file had been returned to the EACC to cover the areas identified for further investigations.

On September 18, 2020, the DPP received an inquiry file from the EACC on the allegations of irregular procurement and fraudulent payments relating to the purchase and supply of Covid-19 emergency commodities at KEMSA which led to the irregular expenditure of public funds amounting to Ksh 7.8 billion.

Sirisia MP John Waluke

Sirisia Member of Parliament John Waluke and his co-accused Grace Wakhungu are not yet off the hook after Justice John Onyiego of the High Court on September 30 released them on cash bail.

Justice Onyiego granted Waluke and Wakhungu Sh10 million and Sh20 million bail  respectively, pending hearing and determination of their appeal.

The judge also gave them an alternative of depositing bonds of Sh20 million and Sh30 million respectively with sureties.

However, the Director of Public Prosecutions (DPP)  has moved to the Court of Appeal to challenge the release of the two on bond.

The DPP has filed a notice of appeal indicating that he is dissatisfied with the decision made by Justice John Onyiego on September 30.

“Take notice that the DPP, being dissatisfied with the decision of the High Court intends to appeal to the Court of Appeal against the decision in which the court released each of the appellants on bail pending their appeal,” reads the notice.

The notice was also served to the lawyers of the two convicts.

The two, who are also directors of Erad Supplies Ltd, were convicted in June by the Anti-Corruption Court for theft of Sh297 million from the National Cereals and Produce Board (NCPB).

The trial court also imposed a combined fine of Sh2 billion. In default, Wakhungu was handed a 39-year sentence while waluke was slapped with a 34-year sentence.

But they challenged their conviction and sentence and sought to be released on bail pending the determination of appeal.

While allowing their request, Justice Onyiego said he was persuaded that the two convicts have an arguable appeal against the lower court’s judgment.

A bodyguard of Githunguri Constituency MP Gabriel Kago Mukuha in the wee hours of the night caused drama when he shot and killed a watchman.

According to reports, the bodyguard had moved to bar premises to have liquor.

Eye witnesses recounted that the constable ordered the watchman to open during odd hours so that he would buy beer.

The watchman then declined to open, an incident that made the MP’s bodyguard to pull out his gun and shoot him.

According to a local daily, the incident happened after a heated exchange ensued between the two, before the constable shot the guard.

He was then rushed to Radiant hospital, Kiambu where he succumbed to gunshot wounds.

Confirming the incident, Kiambu Deputy County Commander Lazarus Wambua said the officer has been arrested as police conduct further investigations.

The officer caused a scene and refused to open his house for close to two hours before he voluntarily surrendered to the officers, and is currently being held at Kiambu Police Station.

Covid millionaires ‘whistleblower’ has been arrested by detectives from the Directorate of Criminal Investigations (DCI).

DCI in a statement posted on social media said three suspects who abducted the Director of Hi-tech Enterprise while personating EACC and KRA officers before demanding for a Kshs 2 Million bribe to stop pursuing an alleged tax evasion case involving the victim were in their custody.

Godwins Agutu, who is one of the people who blew the whistle on Covid-19 millionaires expose is among the three that were arrested.

Agutu who is the Network Action Against Corruption Director featured in an expose aired by NTV alleging widespread misuse of Covid-19 funds and material donations from Jack Ma Foundation.

Agutu was arrested alongside Alex Mutua and Ken Kimathi on Wednesday evening.

They bribed the director asking him to stop pursuing an alleged tax evasion case involving the victim.

DCI boss George Kinoti said that the three were working with three other people who are still at large.

The three escapees are said to be KRA officers namely; Houdouvia Njoroge, Harrison Ochar and Brian Kimemia.

They used two Prados Reg. Nos. GKB 070B & KCY 280Q and stormed the victim’s offices within Nairobi on September 26, 2020, after which they took his laptop and left.

“The suspects appeared again on Sept 29,2020, demanding the Sh2 million bribe, and when the victim could not raise the amount, they forced him into the GKB vehicle and drove off to Lutheran Hse along Nyerere road,” Kinoti said.

Kinoti said the victim was forced to contact his family members to get the amount, but only managed to raise Sh500,000 where the suspects escorted him to his house at Westlands in Nairobi and took the cash.

Investigations were then launched by DCI Detectives where the three suspects were nabbed at the said Lutheran House, further establishing that the registration number GKB 070B belonged to a Land Rover Discovery attached to the Judiciary.

A report by Auditor General Nancy Gathungu has revealed that Kenya Medical Supplies Agency (KEMSA) procurement scandal saw Kenya lose Ksh.2.3 billion.

The report  tabled to the Senate on Wednesday shed light on how KEMSA violated several laws, leading to the staggering losses

The reports notes that for instance, some of the companies that were awarded multimillion tenders had only been around for a few months.

The auditor noted some of the companies that were awarded the contract were established in January and February this year, pointing to possible collusion.

The report also reveals fraud in procurement and collusion between Kemsa bosses and the companies that were awarded multi-billion shilling contracts.

The Senate heard that companies that had been around for less than year were awarded contracts without having the necessary qualifications to supply medical equipment.

According to the auditor, Kemsa over procured items with Sh6.3 billion which are still lying idle in its warehouses.

If the items are sold at the current market prices, Kemsa will only recover Sh4 billion, leading a whopping loss of Sh2.3 billion.

The report shows that Kemsa illegally and irregularly diverted monies meant for UHC to purchase Covid-19 items without approval of the Ministry of Health.

In recommendations to the Senate, the office of the Auditor General calls government agencies to conduct probe to establish criminality in the procurement process and collusion between the management and companies awarded the contracts.

The same report also wants KEMSA to withhold any further processing of COVID-19 related claims until an independent audit is done.

High Court has ordered Nation Media Group to pull down ‘COVID-19 millionaires’ story from their social media platforms pending the hearing of libel case by Megascope Ltd against them.

In their story, Nation Media Group had exposed individuals who benefited from Kenya Medical Supplies Authority (Kemsa) scandal.

According to the expose, some business people chattered planes to China to physically fly in Covid-19 medical supplies.

The story further revealed that some individuals waited for the goods, personal protective gear, ventilators and other medical items to land in Nairobi, then snapped them up in bulk and waited.

Twelve firms,  for instance, were awarded contracts worth Sh3 billion by the Kenya Medical Supplies Authority (Kemsa) to deliver items that were not covered by the state agency’s 2019/20 approved budget as at June 4, 2020, with some multimillion-shilling irregular bids going to friends and well-connected individuals.

Several companies were put on the list of beneficiaries, among them being kilig limited, Abyssinia Group of Industries (AGI), Bell Industries, Medlife Biologicals Limited among many others.

Mega Scope Healthcare had demanded an apology from Nation Media Group for the defamatory investigative story by Dennis Okari which aired on Sunday, August 16.

The company, believed to be associated with the National Chairman of Chamber of Commerce and Industry Chairman Richard Ngatia through its lawyers Njoroge Regeru and Company, said that the investigative piece has destroyed the reputation of its client by terming the company as a dishonest and a corrupt entity.

Through a demand letter written to the Managing Editor, the company has distanced itself from the allegations aired by Dennis Okari, terming them as false and gravely damaging to the company’s image.

On Sunday August 16, NTV ran an investigative piece that widely mentioned Mega Scope Healthcare as one of the companies that allegedly contracted by KEMSA to clear covid-19 kits donated by Jack Ma.

The investigative piece alluded that there were records to show that kits were received the kits, but there was no public record of what happened thereafter.

A 26-year-old woman in Nakuru County has died after being gang-raped by a group of unknown people.

According to reports, the brutal gang of young people inserted a glass bottle and sticks in the woman’s private parts after raping her. 

Further, they also slashed her with a machete during the Saturday, September 19, incident.

Senior Assistant Chief Emitik Sub-Location, Richard Langat, said that the woman was picked immediately by Good Samaritans and taken to Olenguruone Sub-County Hospital for treatment.

He said that the woman succumbed to the injuries on Sunday, September 20, while undergoing treatment at the hospital.

Kuresoi South OCPD Henry Nyaranga said that two suspects have already been arrested as detectives continue to comb the area for their accomplices.

“I have dispatched DCI (Directorate of Criminal Investigations) officers to undertake thorough investigations and appropriate action taken,” he said.

Nyaranga said that the incident is unfortunate and those liable will face the wrath of the law.

Langat, on the other hand, said that the youths could be under the influence of drugs and vowed to work closely with the security officers to root out the menace.

The woman’s body has been moved to the hospital’s morgue.

Embattled Kapsaret Member of Parliament Oscar Sudi will remain in police custody for seven more days.

Sudi on Wednesday September 16, 2020 appeared before Nakuru chief magistrate Josephat Kalo after spending another two days in police cells.

The lawmaker this morning appeared for a ruling on his bail that he had sought.

However, he is not yet a free man as police sought to detain him for seven more days to complete investigations.

The prosecution, led by Daniel Karuri, had sought more time to complete investigations into the crimes allegedly committed by the legislator.

Karuri objected to his release on bond, saying he was being investigated for hate speech, assault of a police officer, offensive conduct, unlawful possession of firearm and bullets and resisting arrest.

The MP was on Sunday airlifted to Nakuru minutes after he surrendered at Langas Police Station in Uasin Gishu County.

Sudi was arrested for hate speech, which is under investigation by the National Cohesion and Integration Commission.

This is after he made remarks deemed abusive towards President Uhuru Kenyatta and his family.

His arrest came after a drama involving the police and his constituents who tried to bar the officers from gaining access to his home to arrest him.

He was aided by police to escape as a team of officers arrived at his home.

During the siege, one of the MP’s supporter was shot and injured while a police officer was attacked by a machete.

Nyeri Town Member of Parliament Ngunjiri Wambugu has finally reached out to  Director of Criminal Investigations (DCI) George Kinoti over politicians that have been using certain phrases in rallies.

In a letter shared on his Facebook page on Tuesday September 15, 2020, the lawmaker has argued that phrases like “Watu fulani” and “Watu wengine” may sound harmless but could be coded by politicians to fan violence against a section of Kenyans.

Wambugu has pointed out Kapseret Member of Parliament Oscar Sudi, his Emurua Dikirr counterpart Johana Ng’eno and the Deputy President William Ruto as the leaders who commonly use the phrases, which he termed as ambiguous.

He has likened the phrases to  “kwekwe” and “madoadoa” which were allegedly used to spread hate messages and incite ethnic violence by politicians during the 2007 General Election.

“Please note that the phrases “Watu fulani” and “watu wengine”are politically ambiguous. In current p[ublic political conversations these phrases are being assumed to refer to particular Kenyan political families. Others assume that these refer to particular Kenyan economic sector. However, some…fear that these phrases could as easily refer to a certain ethnic community,” reads part of his letter.

He said the phrases must be viewed  as dangerous as the “madoadoda” and “kwekwe” encountered in Kenya’s violent history.

Wambugu has therefore urged DCI Kinoti to investigate whether the phrases are meant to incite some sections of Kenyan society against others.

He demanded that appropriate charges be preferred against anyone who has used these phrases in political rallies, should they be found to have meant to incite Kenyans.

Kapsaret Member of Parliament Oscar Sudi will spend two more days behind bars.

The controversial lawmaker was on Monday September 14, 2020 remanded till Wednesday September 16, 2020 when his bail ruling will be made at a Nakuru court at 2.30 pm.

Police and National Commission of Integration Commission (NCIC) sought orders to detain the MP to pave way for investigation on five offences ranging from hate speech to resisting arrest.

The prosecution had initially sought to detain Sudi for 14 days to investigate five counts levelled against him by the State.

In an application filed before a Nakuru court on Monday afternoon, the National Cohesion and Integration Commission (NCIC) through an affidavit sworn by Inspector of Police James Akello, the agency says it is investigating Mr Sudi on the five offences.

The embattled Member of Parliament had been on the run from the police dragnet for the better part of the weekend.

Several security officers had camped around the MP’s home since Friday evening in a bid to arrest the MP after addressing members of the public in Eldoret town where he remained defiant.

Sudi was accused of terming some words that were considered disrespectful to the head of State together with his close family.

Nakuru Chief Magistrate Josephat Kalo is expected to giver a ruling after listening to arguments from both sides.

Detectives from the Directorate of Criminal Investigations (DCI) have arrested two suspects believed to be part of a syndicate that has been fraudulently registering sim cards using stolen identity cards.

The police officer namely Boniface Nthenge who was stationed at Kitengela was on Monday September 14, 2020 arrested alongside a lady by the name Lucy Syombua by DCI detectives based at Kiambu.

The suspects are believed to have been using the fraudulently registered sim cards to acquire loans and other benefits from a leading mobile service provider.

During the arrest, hundreds of fraudulently registered sim cards and an electronic equipment believed to be used for hacking purposes were recovered from the lady’s house in Nairobi’s Umoja estate.

Currently, investigations into other activities of the syndicate are ongoing as detectives continue to pursue other syndicate members for arrest and arraignment.

Last month, DCI detectives nabbed five suspects for their allegedly involvement in electronic money fraud.

The five were arrested within Pavab apartments in Kasarani.

The five were identified as Samuel Githinji Njenga, Wilson Mugo Githinji, James Gitonga Maina, John Ngotho Kariuki and Ian Mbogo Kamau.

The arrest comes at a time when many Kenyans have fallen victim of cyber and economic crimes.

This, has for months seen the DCI constantly warn members of the public through its official social media accounts to be extra careful when dealing with individuals who run online business.

Kapsaret Member of Parliament Oscar Sudi is currently being airlifted to Nairobi after surrendering to Police.

The controversial lawmaker on Sunday morning presented himself at Langas police station, a day after a contingent of police unsuccessfully looked for him at his rural home in Kapsaret, Eldoret.

He was in the company of his lawyers Governor Stephen Sang, Gladys Shollei, Jane Masai, Nathan Tororei and Hon Isaac Terer.

The lawmaker through his official Facebook page notified his fans that he had decided to present himself to to police, as a law abiding citizen.

He however, maintained that he was not at home at the time police arrived at his residence on Friday night to arrest him.

Sudi condemned the move by police, saying that it was unnecessary for him to be arrested dramatically with a contingent of police.

Shortly after surrendering, the controversial lawmaker revealed that he was being airlifted to Nairobi, and that he would be landing at Wilson Airport in the next few minutes.

“I’m being airlifted to Nairobi. Will be landing at Wilson Airport shortly,” he posted on Facebook.

After four hours, police finally managed to break into the home of the Kapseret MP on Saturday morning but failed to arrest him.

“As a law abiding citizen I have presented myself at Langas Police Station early this morning even before the officers arrive. It was unnecessary to be treated with a lot of drama by sending contingent of police officers to my home. I was away the time police arrived at my place. Thank you all for standing with me,” he posted on social media.
