Over the past few days, the whole country was in shock after a doctor based in Nakuru allegedly killed his two children. Reports indicate that Dr. Gakara injected a substance believed to be insulin on his children aged five and and three years old.

According to various sources, Dr. Gakara committed the beastly act after a disagreement with his wife who had made arrangements to go further her studies abroad. His sister however denied the allegations. While speaking to the press, she said that his brother is a cool person who would do anything to protect his children. The claims that he disagreed with wife on going abroad for studies is false because he knew about the plans and supported it by paying for her school fees, said Dr. Gakara’s sister.

The doctor was declared dead a few days after fighting for his life in the ICU. A government pathologist by the name Titus Ngulungu on Friday released the results of the post-mortem done on Gakara’s body. The results showed that Dr. Gakara died as a result of ingesting a foreign substance. He stated that there were injection marks on his arm but they are not sure if the substance was injected by the deceased or by another doctor.

Dr. Ngulungu has urged his family to go on with his burial as they have taken samples of his tissues and organs to establish if he might have been killed. The other results will be out but not sure when. The post-mortem done on the two minors could not establish what exactly killed them and detectives took their samples for further investigations. The two children and their father will be buried in their Mbaruuk home in Gilgil sub-county on Tuesday.

In June this year, a man accused of shooting Nairobi hotelier William Osewe pleaded to be acquitted after he was prosecuted for attempting to kill the businessman.

In his argument, the accused, Tom Mboya said he was acting in self defense after the victim accosted him several times with allegation that he was having an affair with his wife.

The senior Counsel Tom Ojienda argued citing several cases where Mboya was threatened with possibility of elimination.

On Thursday, the accused requested the court to be given more time to obtain evidence before a verdict is made.

Tom Mboya was supposed to be sentenced on Thursday but the lawyer made the surprising application. The defense team argued that allowing the suspect more time to adduce evidence would shed more light on the case and offer a fair judgement to both parties.

The defense team however declined saying the accused wants to buy time after knowing things were not going well for him.

In his defense, Mboya said his actions were only self defense since Osewe is always armed. However, the defense team led by Anderson Gikunda urged the court to find him guilty and sentence him, arguing that it is by chance Osewe is alive.

Tom Mboya said that Osewe has huge influence and he was afraid when he was followed by the complainant and cocked his hand twice but did not shoot.

He further stated that he shot the complainant’s hand to disarm him. “He once told me he would chop off my manhood if I don’t stop sleeping with his wife,” said Mboya.

The ruling on whether to allow his plea will be made on September 27th.

The Director of Public Prosecutions (DPP) Noordin Haji has issued a statement on the claims that a file in the ongoing case on Arror and Kimwarer dam scandals had gone missing.

DPP Haji on Thursday September 23, 2021 while addressing the allegations dismissed them as misleading.

A local newspaper had early this week reported that the file in the case had been misplaced but Haji’s office has clarified that the it was not in any way related to the case on the two dams.

“The only missing file in the case relates to an application filed in the High Court by CMC Di Ravenna companies and their directors,” the statement from the office of the DPP read in part.

The statement signed by Senior Assistant DPP, Alexander Muteti, added that the office had already responded to the matter. He further confirmed that the missing file, which was indeed a court file, had since been recovered.

The DPP affirmed that it was ready and prepared to prosecute the case involving the two multibillion dams in court.

“We are ready to prosecute at the earliest opportunity as and when the date is set for hearing,” the statement added.

Muteti stated that the file was now in custody of the court’s registry and that the article published by the paper misrepresented facts and was calculated to mislead the public.

The ODPP revealed that it would formally raise the matter with the Office of the Chief Justice to ensure that the accurate position is clarified beyond peradventure.

Muteti further explained that the move to notify the CJ’s office is to avoid unnecessary speculation, noting that it was not the first time the said file had gone missing, occasioning delays in the matter.

The case stalled on Monday after it emerged that the file with documents challenging the prosecution of Italian firm CMC Di Ravenna boss could not be traced.

The Italian companies that were dragged into the Ksh63 billion Arror and Kimwarer dams scandals have sued Kenya in the International Court of Arbitration.

Thugs who were aboard a tuk tuk on Monday night held a police boss at gunpoint in Mombasa town and robbed him of his firearm.

According to reports, Mombasa Urban Sub County Police Commander, George Bamba Kingi, was heading home in his private car when a Tuk tuk blocked him on the road.

The thugs are said to have forced officer Kingi to alight from his car, whereby one of the suspects held him at gunpoint and ordered him to surrender his firearm, a Jericho pistol.

The other two suspects stole the pistol, loaded with 15 rounds of ammunition, that was holstered on his waist. The thugs then fled towards Likoni.

“A multi-agency team responded after the police boss raised alarm. The officers combed the area, but nothing has been recovered,” a police report stated.

County Regional Police Commander Manaseh Musyoka condemned the act noting that police officers were working round the clock to ensure the perpetrators are brought to book.

Further, he called upon Mombasa residents to come forth with any information regarding the incident, adding that there was a hefty reward for anyone who would assist the police in recovering the gun and capturing the suspects.

“The suspects, who were all armed, then ordered him to surrender, and since he feared for his life, he cooperated with them.”

“Anyone with information that can assist us to recover the gun to share the information in confidence and there is a reward for that.”

In the recent past, thugs have been devising nifty tactics in a bid to carry out their hatched scheme and evade justice.

From staging heists in wealthy neighbourhoods to robbing police officers, perpetrators are going to extra lengths in order to follow through with their plans.

Four armed bandits on Monday September 20, 2021 raided Ewaso Police Patrol Base under Kimanjo Police Station within Laikipia North sub county in broad daylight and caught officers off guard.

Armed with AK47 rifles the bandits struck at a time when only one police officer was on duty manning the camp.

The base is adjacent to Ewaso Trading Center, which is partly at the border of Isiolo north sub county that falls under the jurisdiction of Oldonyiro Police Station.

Reports indicate that a police constable fell into the trap as the four accosted him in the report office.

The terrified officer could not reach out to call for cavalry as he was disarmed by the bandits.

“They ordered him to hand over his firearm which he had or they shoot him,” a police report filed at Kimanjo Police Station read.

The officer, after realising he had already been cornered, handed over his gun and bullets to the bandits in a move to save his life.

“The officer handed the G3 and two magazines with 40 rounds of ammunition,” the police report added.

As the four bandits were leaving the post, they broke into his house and took away his police uniform, two jungle trousers, one jungle shirt, one smoke jacket, and one green jungle hat.

Cautious not to leave a trace nor raise curiosity, the bandits never fired a single shot during the incident as they stealthy turned the house upside down in search of other valuable goods.

They, later on, crossed to the Oldonyiro side of the boundary towards the Ewaso River direction after boosting their armoury with police weapons seized during the raid at the patrol base.

A multiagency team that was alerted of the incident arrived a few hours later, regrouped and launched a manhunt for the bandits.

The GSU and regular police opted to use trained dogs to track the scent and direction of the bandits and also used a light aircraft from a neighbouring conservancy to conduct a search and track mission.

Police have narrated how a 17-year-old boy was on Thursday night killed by a bullet fired by Directorate of Criminal Investigation (DCI) officers in Nairobi’s Huruma slums.

Haila Asanake died after being hit by a stray bullet fired by DCI detectives.

Police now say that the detectives were repulsing hostility from residents.

Asanake’s family says the teenager was standing on a balcony at their Kiamaiko home at around 8pm, when the bullet fatally struck him.

Police now say DCI detectives attached to Pangani  post had stopped a suspicious motor vehicle, and when the driver of the car alighted, he “started a scuffle with the detectives”.

The resultant melee, police say, attracted other members of the public, who reacted by stoning the detectives.

“This prompted officers to shoot in the air,” says a police report filed at the Huruma Police Station under the OB Number 70/09/09/2021.

Asanake, who was allegedly killed by the fired bullet, died on arrival at the Jumuia Hospital, where his body is currently preserved awaiting postmortem.

The deceased’s uncle, Branu Boku Cheme, said the teenager was a law-abiding boy, who occasionally earned money from working as a porter.

Mathira MP Rigathi Gachagua’s woes are going deeper after a man claiming he was conned out of Sh123 million by the lawmaker now claims he was recently forced to sign an affidavit indicating the cash was paid into his bank accounts.

Earlier this year, Jim Carter Njagi had told the High Court that Gachagua conned him out of Sh123 million by pretending he would help him fund a project.

The project was for the supply of hospital operating theatre, ICU and maternity equipment to Bungoma county.

In court documents, Njagi said Gachagua promised to help him.

Instead, he said, Gachagua used him and his company as a conduit for money laundering to syphon funds from government departments. Njagi is a director and shareholder of Encartar Diagnostics Limited.

He made the claims in a case whereby the Assets Recovery Agency (ARA) is seeking to have him forfeit Sh200 million believed to be the proceeds of crime.

Njagi said that on March 11 this year, he received a call from Gachagua asking him to go to his office at Liaison House near State House.

He proceeded and upon arrival, he was directed by the secretary to the boardroom. Rigathi and three other men, one of them a lawyer, were waiting for him there, Njagi said.

“Rigathi then proceeded to show me a copy of a statement I recorded with police officers attached at the Assets Recovery Agency. He asked me why I indicated in the statement that he did not pay me my money,” Njagi’s statement reads.

Rigthai then gave directions to the lawyer present and subsequently gave Njagi an affidavit to sign, Njagi said.

Gachagua left the room and Njagi was given an affidavit that he signed, without being given an opportunity to read it over and understand the contents, he said.

Officer Fredrick Musyoki, an officer attached to ARA, said that on June 8, he recorded Njagi’s statement about the veracity of the affidavit he allegedly signed at Gachagua’s office.

The affidavit dated March 11 this year was commissioned by an advocate identified as Meschack Obare. It was about payments to Encarter Limited, Njagi’s company, by the Bungoma and Kwale county governments.

Njagi has now disowned the affidavit, saying he did not write it.

“I was not consulted when the affidavit was being written. I did not consent to the preparation and writing of the affidavit,” he said in his statement

He said signing the affidavit was not free and fair and he was not allowed to read the affidavit before signing.

Regarding requests to cross-examine ARA investigator Musyoki on his affidavit, ARA disputes them. It argues Gachagua has not indicated what he does not understand and wishes to cross-examine him on.

“Gachagua has not filed any formal application seeking my cross-examination and is engaging delaying tactics so as to frustrate the expeditious conclusion of this matter,” Musyoki said.

ARA wants Gachagua to forfeit more than Sh200 million, suspected to be the proceeds of crime.

In his affidavit, investigator Musyoki detailed how the MP allegedly planned with his business associates to acquire the money from various state agencies through money laundering and corrupt practices.

The MP has claimed he is being persecuted for being a close ally of Deputy President William Ruto and said his wealth has nothing to do with money laundering.

He said the money is from legitimate businesses. This has been denied by ARA.

Kenyans on Twitter have expressed mixed reactions after six police officers accused of killing the two Kianjokoma brothers filed a case seeking to exhume their bodies.

The police officers who are still in custody have filed a case through their lawyer Danstan Omari seeking to exhume the two bodies for a postmortem to be redone.

Benson Mbuthia, Consolota Kariuki, Nicholas Cheruiyot, Martin Wanyama, Lilian Cherono and James Mwanikiwere who were arrested after investigation agencies concluded their inquest now want a further inquest done before any charges are preferred against them.

They argue that when postmortem on the cause of death of the two deceased brothers Benson Njiru and Emmanuel Ndwiga was conducted, the petitioners chosen pathologists were not present.

It is their argument that while being ferried together with others and in the same police vehicle, the two brothers “in a suicidal act while escaping lawful custody jumped out of the moving police vehicle thus succumbing to injuries.”

However, their request to have the bodies exhumed has stirred mixed reactions from netizens.

A section of Kenyans on Twitter argue that the officers should stop disturbing the dead and let them rest in peace.

Others argue that this might be a well calculated move to frustrate the deceased’s parents so that they can give up on seeking justice for their two children.

Below are some of the reactions.

A prison Warder who was arrested by DCI detectives while allegedly on a mission to kill his girlfriend was not okay if his social media posts are anything to go by.

Edwin Omuse who disappeared from duty on Tuesday armed with a G3 rifle was arrested in Thika at his girlfriend’s house.

According to DCI, Omuse stormed out of Kangeta GK prison in Meru carrying the carefully concealed rifle in a sack.

The rifle, DCI say, had a magazine loaded with 20 rounds of ammo.

He was earlier overheard saying that he would travel to Thika to eliminate his girlfriend who had allegedly defrauded him Kshs. 900,000 that he had borrowed from a financial institution.

However, his social media posts that have hence emerged can tell that Omuse was not okay.

In one of his posts, Omuse posted agreeing to one of the relationship quotes that talks about rejection.

“When a woman rejects a man of a vision and accepts a man with a television, she will end up watching the man with a vision on her won husband’s television. Don’t judge a man by his pocket but judge him by his vision. Because where a man is going in life is more important than his present condition. Stay blessed,” reads the quote which Omuse concurred with.

He then in one of his posts posted a grave stone bearing his name.

In another post, he shared a photoshopped image of himself making headlines in newspers after becoming successful.

Another post was talking about his colleagues who seem to be giving him a hard time.

“Some colleagues of mine amaze me,.mtu anaingia kwako unafikiria Ako uzuri kumbe anachunguza nyumba Yako. Why don’t you mind your own business!! Hope you know yourself, shame on you!!” reads the post.

He again posted saying that something somewhere was not going well on his side.

He is currently in police custody awaiting arraignment in court.
