Authorised Apple Reseller Personal Systems Limited, has launched its refurbished Apple products and accessories store situated at the Ground floor of the Yaya Centre, Nairobi. The refit, worth over USD 50,000(Ksh 5,000,000) was fully funded by Apple through Redington; the Apple Appointed Independent Value Added Distributor for Africa.

The refurbishment was occasioned by Apples’s continuous desire to enrich the customer experience in tandem with the industry’s fast changing trends. Sarah Wairimu, the wife of murdered Dutch businessman Tob Cohen, has been taken to the High Court for plea taking.

Wairimu, who was charged with her husband’s murder, was yet to take plea pending the mandatory mental health check for suspects in murder cases.

Justice Stella Mutuku, whom she is appearing before, is also to rule on whether Wairimu’s lawyer, Philip Murgor, will continue as her attorney after objections were raised.

The court was told that the former Director of Public Prosecutions was still serving as a special prosecutor for the DPP following his appointment in a special panel by current top prosecutor Noordin Haji.

It emerged that Murgor had bot be degazetted as a state counsel.

Her plea taking was pushed from September 26 to October 1 after the prosecution and lawyer Cliff Ombeta for the Cohen family contested Wairimu’s representation by Murgor.

KTN News show presenter has faulted Kenyans over Likoni ferry tragedy that saw a woman and her four-year daughter lose their lives after their car slid off the ferry on Sunday evening plunging 60 meters deep the Indian Ocean.

Kenyans have been criticizing the government over the tragedy, arguing that little is being done by the state to retrieve the bodies of the victims.

Some are arguing that the government has been careless to allow nonseaworthy ferries to carry on with their operations along different crossing channels at the Kenyan Coast.

But taking to his twitter account on Tuesday morning, KTN PointBlank presenter Tony Gachoka faulted Kenyans for blaming the government for everything as he questioned the role of a citizen.

Efforts to retrieve the bodies and the car have been futile, 48 hours later.

The operation is however still going on after the government on Monday sourced for diving equipment from a South African company to help undertake the operation.

Mariam Kigenda Taita, 35, and her four-year-old daughter died after the vehicle they were traveling in slid off MV Harambee Sunday evening.

The family’s relatives, including Mariam’s husband on Monday camped at the Likoni channel as they waited in vain for KFS to retrieve the bodies of their kin.

Frustrated, they faulted the government for not doing enough especially since in navy officers could be seen nearby conducting drills.

A Moroccan journalist has been sentenced to a year in prison for premarital sex and having an abortion, in a case activists say is part of a crackdown on critical reporters.

Hajar Raissouni was arrested with her fiancé as they left a gynaecologist’s clinic in the capital, Rabat, in August.

According to BBC News, the 28-year-old denied the charges, saying she had sought treatment for internal bleeding.

Ms Raissouni works for an independent newspaper critical of the authorities.

A journalist at the Akhbar Al-Yaoum daily, she denounced the case against her as a “political trial”, saying she had been questioned by police about her family and her writing.

Wearing a black veil covering her head, Ms Raissouni appeared calm on arrival at the courtroom in Rabat. She and her fiancé, a Sudanese national, denied that an abortion had taken place.

The delay of operation to retrieve bodies of a woman and her daughter from Indian Ocean over lack of equipment to pull out the car that plunged 60 meters deep on Sunday evening after slithering off the ferry has seen government attacked.

This has brought Transport Cabinet Secretary James Macharia and the Prrsident Uhuru Kenyatta-led government under a heavy attack.

Flamboyant city lawyer Donald Kipkorir has blasted CS Macharia arguing that the CS is a poster child of government incompetence, ineptitude and hubris.

He argues that under CS Macharia, Kenya Ferry Services operate unseaworthy Ferries, Billions have been spent to paint roads allegedly for BRT, the Standard Gauge Railway (SGR) turned out to be fake Project, Kenya Airways collapsed and Useless roads are built.

“CS James Macharia is poster child of Gov’t Incompetence, Ineptitude & Hubris … Under him, Kenya Ferry Services operate unseaworthy Ferries,Billions spent to paint roads allegedly for BRT, SGR turned out to be fake Project,Kenya Airways collapsed, Useless roads are built,” he tweeted.

Coast Regional Coordinator John Elungata on Monday said that Kenya Ferry Services Managing Director Bakari Gowa should take responsibility for the Sunday accident at the Likoni Ferry.

The regional administrator said operation to retrieve bodies of a woman and her daughter from Indian Ocean was delayed over lack of equipment to pull out the car from the Indian Ocean.

However, he said the government has been forced to source for diving equipment from a South African company to help undertake the operation on Tuesday.

Well, National Transport and Safety Authority has suspended nine matatu Saccos for failing to comply with the provisions of the laws.

NTSA director general Francis Meja said in a statement on Monday that the nine failed to comply with section 5(1)of the NTSA’s regulations.

Meja urged the public not to board any vehicles belonging to the saccos to avoid any inconveniences. 

Companies affected include Mwamba Sacco which operates Komarock-Jogoo Road-Mfangano Street. 

Some of Mwamba Sacco vehicles operate on Mfangano Street-Eastleigh, Jogoo Road-Buruburu-Civil Servant-Garage. 

Marvellous Travellers Sacco which operates from Komarock-Savannah-Jogoo Road-Eastleigh-Mfangano Street was also affected. Fig Komba Sacco which operates from Dandora-Juja Road-Gikomba-Fig Tree-Ngara-Kiambio-Mathare North had their licence revoked September 27.

The license for Moonlight Coach Company which operates from Commercial-Thika Road-Mathare North has also been revoked.The authority also suspended Mwirona Sacco which operates from Bus Station-Thika road, Kasarani-Mwiki.   

Huruma Minibus that operates on-Pangani-Kariokor-Tusker Bus Station also had its licences revoked.

Also revoked was the license of Transafaris Sacco which operates from Nairobi-Nakuru-Kisumu-Busia.

The sacco also operates Nairobi-Busia-Nakuru-Kericho-Kisumu and Nairobi-Nakuru-Kisumu-Kakamega-Bungoma.

Kenya Ferry Services has hired a private firm to locate and recover vehicle with its occupants following the Sunday evening tragedy, Managing Director Bakari Gowa says.

For over 12 hours after a saloon car plunged into the Indian Ocean killing a mother and her 4-year-old daughter, the family of the deceased is yet to receive the bodies of their loved ones. 

Mariam Kigenda Taita, 35, and daughter died after the vehicle they were traveling in slid off MV Harambee Sunday evening.

Grief-stricken family members now say not enough is being done to retrieve bodies of their kin.

Kenya Ferry Services (KFS) has earlier said it has no divers who can retrieve the bodies and are waiting for help from Kenya Navy divers. 

KFS and the family of the deceased, including Mariam’s husband, are camping at the Likoni channel, waiting for help to get the bodies and vehicle out of the sea.

Private divers – who have previously played a key role in rescue and retrieval efforts – have refused to participate in the exercise, citing non-payment for their previous work.

A section of Mombasa residents have accused KFS management of negligence, asking how officials failed to rescue the mother and child.

Residents further questioned KFS’ ability to assure the safety of the thousands that use the cross the Likoni channel daily.

A Senate committee has recommended the arrest of Machakos County governor Dr Alfred Mutua.

The Senate County Public Accounts and Investment Committee was incensed on Monday after Mutua failed to appear before it for the third time.

Mutua was summoned to respond to audit queries in the 2015/16, 2016/17 and 2017/18 financial years.

The Public Accounts and Investment Committee (PAIC) chaired by Homa Bay Senator Moses Kajwang begins a three-day whirlwind tour of the three counties in Ukambani region to investigate alleged misuse of public funds.

Governors Alfred Mutua (Machakos), Kivutha Kibwana (Makueni) and Charity Ngilu (Kitui) have been summoned to appear before the Kajwang committee to respond to audit queries and petitions raised by both the Auditor-General and locals.

However, the committee was forced to cancel Monday’s session after the Machakos County Assembly said it will not be available to host the intended Senate PAIC sittings because it is on recess.

In a letter seen by the Nation, Assembly Clerk Felix Mbiuki said he was only notified by telephone of the planned sittings in their chambers but MCAs and staff are also participating in the County Assemblies Sports Association (CASA) national games in Eldoret, Uasin Gishu County.

Orange Democratic Movement (ODM) party leader Raila Odinga will be left homeless if Kibra constituency is taken away from him, political analyst Ambrose Weda has said.

Speaking on Monday morning during a morning talk show dubbed Morning Express on KTN News, Weda said that Kibra is like Raila’s home since he has represented it for a long time.

The analyst says that despite Raila’s native home being Bondo, his real political home is Kibra.

His remark comes a day after various aspirants in the forthcoming mini polls stormed Kibra on Sunday to launch their manifesto.

Jubilee Candidate McDonald Mariga, Ford Kenya candidate Khamisi Butichi, ANC’s Eliud Owalo and ODM’s Imran Okoth were in different parts of the constituency to woo voters.

While Mariga, Owalo and Butichi held rallies in different locations, Imran resolved to doing door to door campaigns after attending several church services in the region.

However, out of the three rallies, Mariga is believed to have had a huge crowd, which has been seen as a bigger threat to Raila’s ODM, an incident Kenyans say is an upper hand for Mariga.

Deputy President William Ruto has already expressed confidence that the Jubilee party will triumph in the coming Kibra Constituency By-elections scheduled for November 7th.

Ruto said that already, the Jubilee administration has transformed Kibra through the construction of roads and toilets, which he said had not been done for several years, despite the leadership of former Prime Minister Raila Odinga.

Inmates at the Kamiti Maximum Prison on Monday refused to take their morning porridge to protest ongoing search for contraband in their cells.

Kamiti prison authorities said the situation is under control after reports emerged that there were confrontations between warders and inmates.

According to reports, the trouble started after some inmates resisted surrender of contraband.

Kamiti is Kenya’s biggest maximum security prison with cameras and hawk-eyed guards who screen people, vehicles and goods entering the correctional facility.

But criminals still sneak contraband into the facility in a racket suspected to involve warders and managers.

In past mop-ups, prison officers seized laptops, internet modems, sim cards and mobile phones— tools that inmates use to swindle unsuspecting members of the public.

Other contraband include cigarettes, hard drugs, knives and daggers curved from iron rods, electric cookers and coils and razor blades.

Sex, violence and property were at the heart the divorce between Dutchman Tob Cohen and his wife Sarah Wairimu, papers obtained by the Star show.

The court papers, exclusively obtained by the Star, paint a picture of marriage with sky-high hostilities, one that was irretrievably ruptured and had become conjugally nonexistent.

The Dutch businessman appeared to make every effort to push Wairimu out of their Lower Kabete home, the papers indicate.

Cohen went missing in July and the police found his body in an empty water tank in his home compound on September 13. It was a brutal murder.

 Widow Wairimu, 52,  is being held at Lang’ata Women’s Prison and is to plead to a murder charge on Tuesday.

It was the 71-year-old Cohen who first filed for the annulment of the union on January 21 under a certificate of urgency. He claimed that Wairimu had been denying him sex since 2014.

He said they were sleeping in separate bedrooms and he was preparing his own meals.

On February 25, Cohen amended the grounds for dissolution of the marriage to include cruelty and violence from Wairimu.

The Dutchman said that on one occasion Wairimu had stormed into his office, thrown water on him and warned, “Do not think that this is all; this is not over.”

He also said that four days later, Wairimu assaulting him, causing “cut wounds and multiple bruises and as a result…[I] suffered pain and agony.”

“[After pushing him off a flight of stairs]..while the applicant was lying on the ground, bleeding, the respondent came on top of him and started punching him and kicking him,” the petition by lawyer Judy Thongori reads. 

Cohen urged the court to order the OCS of Spring Valley police station to evict Wairimu from their home pending the determination of the case.

In 2015, as their marriage continued to deteriorate, Wairimu put a caveat on the land to stop its sale, a copy of which the Star has obtained. Documents show that Cohen attempted to remove the caution via an application dated July 1, 2019.

Wairimu’s rejoinder

But in a rejoinder in a sworn counter-affidavit, Wairimu “admits that the marriage had irretrievably broken down but avers that the break down is on account of adultery and cruelty on the part of petitioner [Cohen].” 

Asserting that she also wanted a divorce, Wairimu dismissed the claim that she was violent, arguing that this was a ploy by Cohen to paint her as a bullying spouse. 

The particular attack started by Cohen was staged by him to build his divorce narrative, she said.

She also dismissed the claim of denial of conjugal rights, saying that they always shared the master bedroom except in sporadic occasions when she had been “forced to take refuge in our daughter [Renee] Gathoni’s bedroom during times when the applicant is excessively intoxicated and abusive.”

“It is only in December 2018 that the applicant started claiming that we have not been intimate for four years and I believe that the claim is intended to [be a] narrative that the marriage has broken down,” she wrote. 

Their 31-year-old daughter lives in the Netherlands with her husband, the papers read. 

Wairimu further said that though they would engage in sex, Cohen was highly ineffective some times failed to perform as he was an abuser of drugs and had secretly undergone a procedure that sabotaged him.

“The applicant underwent a prostrate operation which seems to have affected his ability to engage often or effectively in the manner that he did before the operation,” she claimed.

This situation made him increasingly “unreasonable, aggressive and rude and he would often come home in the early hours of the morning in an extremely intoxicated state,” Wairimu said.

She did not give the dates of the procedure or where it was performed.

The medical procedure, she claimed, resulted in Cohen engaging in an extremely erratic lifestyle with “disruptive sleeping patterns which involved kicking me at night on the claims that I snore and waking up numerous times all through the night to smoke”.

She also claimed that Cohen was a womaniser who would come home with makeup on his shirt.

Wairimu painted Cohen as a frustrated amorous old man out to evict her from their matrimonial home so he could entertain other women.

“The very intention of the petitioner is to ensure my removal from the matrimonial home so that he can have the home to himself to entertain other women of his choice as he pleases,” she writes.

She said that on one occasion while she was away, Cohen had brought another woman to their home, including the bedroom. When she asked, he responded that the woman was his future wife from Machakos, the papers read

The papers also show that Cohen was particularly angered by the reportedly secret construction of a property in Nyeri in By Wairimu.

However, the widow told the court that she never had any construction in Nyeri and that it was Cohen who had a secret construction going on in Murang’a, together with advocate Chege Kirundi. 

“…there has never been anything secret about the property in Nyeri. The applicant has all along known of my ownership of one-acre piece in Nyeri. Our daughter Gathoni expressed the desire to construct a house on the said plot and I asked the applicant if he was willing to partner with her on the project but he expressed no desire at all…citing that his funds were committed to an ongoing construction project in Murang’a county which he was doing in partnership with his friend and lawyer Mr Kirundi,” she swore in the her affidavit.

Kirundi was the lawyer who presided over the opening of the Dutchman’s will last week. He did not disclose its contents.

Staking claim to their home on Lower Kabete Road, Wairimu said they had been cohabiting as man and wife since 1998, bought the land and constructed the house together.

Hence, she said she owns it as much as Cohen did.

Former Bomet governor, Isaac Rutto, on Sunday faulted the govt eviction of settlers in the Maasai Mau trust land.

Rutto, who was appearing on K24 TV’s Punchline show with Anne Kiguta, said the Maasai Mau has not been gazetted as a forest and the 60,000 people being kicked out should be compensated.

Confronted with the findings of a task force created by the former prime minister Raila Odinga into the encroachment of the Maasai Mau, Rutto faulted the team for not writing a memo to the Cabinet that would have formed a basis for a bill to gazette the land as a protected area.

“Maasai Mau is not government land. It is not under the Kenya Forest Service. It is not gazetted as a forest. We have not reached a solution to the Mau issue because every other time a solution is being pushed from the top. I would like a situation in which there is a clear discussion and engagement between the government and local community,” said Rutto.

The former governor said that land from which settlers are being evicted from has three ward representatives, several schools and government-built roads, including one that was officially launched by President Uhuru Kenyatta.

“There is a certain area in Maasai Mau that is a catchment area. Do a survey and give us the coordinates. Officially, it is not a water catchment area. It is just a statement,” said Rutto.

In August this year, the government halted the second phase evictions of settlers from the Maasai Mau forest but gave them 60 days to voluntarily vacate the area.

The 60-day notice was given after government administrators were accused of kicking out the settlers inhumanely.

A 10-member task force was also formed, headed by the Rift Valley Regional Commissioner George Natembeya, to over devise a plan for the second phase evictions.

The team comprises members from Kenya Forest Service, Kenya Wildlife Service and the Ministry of Environment.

Ethiopia’s Kenenisa Bekele has won the 2019 edition of the Berlin Marathon, coming just two seconds short of beating the world record currently held by Kenya’s Eliud Kipchoge.

Bekele ran 2:01:41, and missed the World Record by 2 seconds.

Bekele was faster than Kipchoge at 40km. By only 2 seconds – 1:55:30 for Bekele vs 1:55:32 for Kipchoge. But Kipchoge’s final 2.2km were 4 seconds faster than Bekele’s today.

Bekele staged an astonishing comeback to clock 2:01:41, setting the second-fastest time in history. Fellow countryman Birhanu Legese who dominated the better part of the race finished second in 2:02:48, becoming the third fastest marathon runner ever.

Sisa Lemma emerged third in 2:03:36, as the trio completed an all Ethiopian podium in the race.

Kenyan athlete in the ongoing Berlin Marathon 2019 Gladys Cherono has just pulled out the race after getting injured along the race.

Cherono dropped out at about 32km for what looks like an injury with medical team turning out to give her attention.

Cherono was trying to break her personal best time and course record she set in last year’s race.

In the women’s race, Dibaba, Bekere, Chepyego and Tola are in the lead after Cherono dropped out.

The 36-year-old clocked 2:18:11 in winning her third Berlin marathon last year, which made her the sixth fastest in history.

The Olympic qualifying time for the women’s marathon in next year’s Games in Tokyo is 2:29:30, a target also shared by the home favorite Anna Hahner.

This year the Berlin marathon has already established a record with 46,983 runners entered.
