Magistrate that granted Embakasi East MP Babu Owino controversial bail terms has quit the lawmaker’s attempted murder case.

Chief Magistrate Francis Andayi has decided to withdraw himself from the case as state seeks to have the bail terms reviewed.

His withdrawal comes after eyebrows were raised following the bail terms that were granted to the youthful MP at the time of his release.

The Director of Public Prosecutions had faulted bail terms issued by a magistrate’s court in freeing the youthful lawmaker.

DPP Noordin Haji said he was taken aback by the court’s decision to release the legislator on what he termed as “free bond” and now wants the High Court to call the file from the trial magistrate, with a view of examining the circumstances, legality, and propriety of the orders issued on January 27.

The MP who is charged with attempting to murder Felix Odhiambo Orinda (DJ Evolve) was released on a Sh10 million cash bail to be paid in installments and channeled towards the victim’s hospital bill.

Magistrate Francis Andayi had ruled that the MP shall meet the initial medical expenses of the victim and to this end up to the value of Sh10 million, an amount he said was equivalent to the value of cash bail the court had set for him.

On the other hand, Babu had also filed an application seeking a review of his bail terms on the grounds that he would struggle to pay the remaining installments despite having complied with the court order.

Recuperating Jubilee Party Secretary General Raphael Tuju’s duties have been taken over by Jubilee executive director James Waweru.

In a move seemingly taken by the party to see its operations run in absence of SG Tuju, Waweru will be assisted by directors.

In a statement released on Monday, Jubilee communications director Albert Memusi said Tuju is now conscious and fully in control of his limbs.

However, he said Tuju has been immobilised to minimise aggravation of injuries.

“Doctors managing Tuju have started the process of weaning him off sedation and so far all indications are that his injuries are healing well,” Memusi said.

“He is conscious and fully in control of his limbs just as he was when he walked into the accident and emergency section of Kijabe hospital.”

“The family through the party wishes to thank all those who have been praying, sending messages of goodwill or encouraging them in one way or another.”

The family has further requested that Tuju be allowed more time to recover before he can be visited. It has also reassured all that Tuju is under the able hands of both in-house and consultant health care givers.

Tuju was rushed to AIC Kijabe Hospital on Wednesday last week, together with his bodyguard and driver by good Samaritans following an accident on their way to Kabarak to attend the burial of former late President Daniel Moi.

They were later all airlifted separately to Nairobi.

Tuju’s car collided with a matatu belonging to Nuclear Sacco, which was heading towards Nairobi.

Deputy President William Ruto’s long time aide Farouk Kibet has hatched plot to milk millions from the late Mzee Daniel Moi’s family-owned company.

Farouk has moved to demand what he has termed as a reasonable offer for damages from Standard Media Group.

Farouk is also demanding an apology from the Mombasa road-based media house.

This follows a controversial story ran by the media house’ newspaper that linked three of DP Ruto’s aides to the Ksh 39 billion military arms deal.

According to the story ran by The Standard, detectives from Directorate of Criminal Investigations (DCI) on Friday camped at DP Ruto’s office.

The detectives were also said to be keen to rope in all the ring leaders of the scheme as well as to corroborate the evidence adduced by the victims.

Of key interest were three top officials of the office who by the virtue of their positions ought to have been in the know when such a humongous deal was being struck.

These are long-time personal aide of the DP Farouk Kibet, Chief of Staff Ken Osinde and Private Secretary Reuben Maiyo.

Echesa who was arrested on Thursday last week was on Monday released on a Sh1 million cash bail amid investigations into the Sh40 billion arms fraud case involving American organisations, Echo Advanced Technologies.

At the Milimani Law Courts on Monday, Mr Echesa was charged alongside three people — Daniel Otieno, Clifford Okoth and Kennedy Oyoo.

They all denied charges of conspiring to commit a felony, making a document without authority, obtaining money by pretence, attempting to commit a felony and uttering a false document.

Mr Otieno, Mr Okoth and Mr Oyoo were also released on the same terms.

Deputy President William Ruto has finally come out clean fake military arms tender that was allegedly procured from his Harambee Annex office.

In a statement issued on Monday evening by his communication office, DP Ruto distanced himself from the scandal in which former Sports Cabinet Secretary Rashid Eachesa is largely involved.

Ruto says he was not in the office when Echesa and two other foreigners visited his office.

The DP has also stated that Echesa lacked an appointment with him on the material day when they visited his office to ‘seal the deal.’

When Echesa and company got wind that DP Ruto was working from his Karen home instead of Harambee Annex, they bolted out of the reception according to DP’s statement.

The group had been holed up inside the Annex office between 9:39 and 10:02, making it a total of 23 minutes.

Echesa has since been released on a Ksh1 million bail together with Clifford Okoth Onyango, Daniel Otieno Omondi and Kennedy Oyoo Mboya.

DP Ruto said his office has been cooperating with detectives drawn from Directorate of Criminal Investigations and that all the CCTV footages had been made available for review.

On February 15, DCI detectives raided the houses of Echesa where they recovered two guns and more than a hundred rounds of ammunition.

Monica Juma-led Ministry of defence has finally spoken on the ongoing investigations into a fake military tender in which former Sports Cabinet Secretary Rashid Echesa is highly involved.

The ministry on Monday sent a statement to newsrooms distancing itself from the Ksh 40 billion deal allegedly procured by Echesa from Deputy President William Ruto’s office.

In a statement signed by the Ministry’s head of communication Bogita Ongeri, the ministry confirmed that indeed investigators and complainants in the saga on Monday visited its headquarters at Ulinzi House to ascertain the officers and offices they allegedly accessed.

“During the visit it was established that the complainants have never interacted with any official mandated to represent the Ministry of Defence. The visit further revealed that the complainants have never been to (Ulinzi House), the Ministry of Defence Headquarters as has been alleged,” the statement read in part.

The ministry further stated that all the documents and content displayed in the media pertaining the matter never originated from the Ministry of Defence.

It distanced itself from the alleged involvement in the fake arms procurement scam that last week shocked the country.

The ministry also raised concerns that a section of the media was creating a narrative that was scandalous and libelous in spite of what is clearly a fraudulent and criminal act.

“The Ministry of Defense intends to seek redress for this matter,” the statement further revealed.

Mr Echesa was released on a Sh1 million cash bail amid investigations into the Sh40 billion arms fraud case.

The former CS had been arraigned alongside three people identified as Mr Daniel Otieno, Mr Clifford Okoth and Mr Kennedy Oyoo.

Mr Echesa was nabbed outside Deputy President William Ruto’s office but the latter has distanced himself from the scandal.

It has emerged that two of his aides were captured on a CCTV footage showing that they were present during a meeting with the foreigners who work for Echo Advanced Technologies, an American based company.

A Nairobi woman on Sunday found herself in trouble after attempting to access Deputy President Dr William Ruto.

In a video doing rounds on social media, the woman was tossed away, falling on the ground the moment she came closer to the DP.

Ruto’s body guard who shoved the woman to the ground is not bothered to see whether she got hurt or not.

DP and his entourage then carry on with their walk to his vehicle as the woman is helped up by fellow congregants

The incident happened as the deputy head of state exited a church in Dandora, where he had attended a religious service, alongside his Tangatanga troops.

”Ruto!Ruto!Ruto!” the crowd chants as all the drama unfolds.

Kitui County governor Charity Ngilu has revealed another victim of fraudulent activities allegedly happening from Deputy President William Ruto’s office.

Ngilu on Sunday evening issued a statement listing some of the fraudulent activities that have previously happened in the office of the second in command.

Ngilu says it is now evidently clear through his (Ruto) own admission that these activities have been taking place in his office, which he admitted in his tweet that the meeting took place albeit for 23 minutes.

The Kitui county chief says Stephen Ngei Musyoka, a proprietor of Makindu Motors, is a living victim of these mafia like schemes that take place at the DPs office.

In 2018, in a similar run in with conmen operating from Dr Ruto’s office, Mr Musyoka supplied 2,800 laptops worth Sh200 million. To date Mr Musyoka has never been paid.

Ngilu has called for the resignation of DP Ruto to allow investigations to take place.

“The Deputy President should stop hoodwinking Kenyans through tweets and do the honorable thing, STEP ASIDE and let investigations be conducted in an impartial environment,” Ngilu says in part of her statement.

During the raid at Ruto’s office, the detectives checked into the building to view the Closed Circuit Television (CCTV) footage for the period of interest to them.

Ruto  was yesterday furious with the turn of events implicating his office.

The news that his office was a place of interest to detectives also unfurled a wave of criticism by his political rivals demanding he tells his side of the story.

“Go for the fraudsters. Leave me to serve the nation,” Ruto tweeted in reaction to the Saturday Standard story naming his office as the theatre of the alleged fraud.

“The desperation of my political competitors on their choreographed smear campaign against WSR is evident even for fools (whom we have a shortage for) to see. Just wait and see where this will end up. Washindwe!” he wrote.

Former Sports Cabinet Secretary Rashid Echesa is no longer new to controversies! Or is he?

Well, after his arrest on Thursday, details have emerged of how the former ODM party youth leader used the office of Deputy President Dr William Ruto and Defence Cabinet Secretary Monica Juma’s signature to strike a multi-billion fraudulent deal.

According to The Standard, Echesa is said to have used the Office of the Deputy President and the signature of the Defence Cabinet Secretary to cut the fraudulent multi-billion-shilling deal to supply military surveillance equipment and guns.

The complainant, who is an American based in Poland, told the police Echesa approached them through e-mail, introducing himself as a Kenyan politician who would hook them up with a lucrative Sh39.5 billion tender.

The complainant said Echesa summoned the directors of the company into the country and had a meeting at a Nairobi hotel in the presence of people dressed in military uniforms, one of them introducing himself to the investors as a general who would be the user of the military equipment to be supplied to the Department of Defence.

The directors then arranged a trip for Echesa and three others to Poland, the headquarters of the company to inspect the surveillance equipment.

It is here that he said he would receive Sh52 million upon the signing of the contract after allegedly approving the standards of the equipment.

The victims told the police that they were on Thursday shocked to establish the man who identified himself as a military general was dressed in a suit this time round.

They also said they never got to meet the Deputy President despite Echesa promising that the contract would be signed in his presence.

What baffled investigators is that the fictitious tender document found both in the Office of the Deputy President and in Echesa’s car, bore the signature of CS Juma, among other senior ministry officials.

Forensic investigations on the signatures have been launched as part of the probe.

Another Member of County Assembly (MCA), the nominated Meru MCA Petronilla Gainchi is dead.

Petronilla has passed on at a Nairobi hospital after illness.

Meru County Assembly Speaker Kaberia Arimba has announced the passing on of the MCA.

This comes barely two days after the death of Kahawa Wendani MCA Cyrus Omondi.

Omondi was found dead in his hotel room in Mumbai, India, on Wednesday while on an official duty.

Kiambu Senator Kimani Wamatangi described the death of Mr Omondi as a great loss to the people of Kahawa Wendani and Kiambu as whole.

“Cyro will be remembered for his passion and dedication to his work both in the county assembly and in his ward,” said the senator.

He added: “Through Cyrus, the people of Kahawa Wendani and Kiambu demonstrated that it is possible to rise above petty considerations and elect a leader based on merit. This, indeed, is the true spirit of the great people of Kiambu. I wish to pass my deep and heartfelt condolences to Cyrus’s family, relatives, friends, the people of Kahawa Wendani and Kiambu in general.”

Nominated Senator Isaac Mwaura, who condoled with the family, termed the late Omondi a hero who showed that ethnicity was slowly losing its place in Kenya.

Deputy President Dr William Ruto is set to attend his first ever Building Bridges Initiative (BBI) rally.

According to Gatundu South Member of Parliament Moses Kuria, who is also a staunch Tanga Tanga member, The DP will attend the Meru BBI rally.

Ruto will be attending the rally alongside its brainchild the ODM party leader Raila Odinga.

The rally is scheduled for February 29, 2020, with Moses Kuria noting that it will be the best rally so far.

“The Meru BBI rally on 29th February will be the best so far. If inclusivity is one of the aspirations of the BBI, this will be the hallmark of the Meru rally with the Deputy President H.E Dr William Ruto set to attend for the first time alongside former Prime Minister Rt Hon Raila Odinga. This is the Kenya we want,” he posted on facebook.

The first Mt Kenya region BBI meeting was to be held in Meru County on February 15 but was postponed to allow national mourning following the death of former President Daniel Moi.

Meru Governor Kiraitu Murungi said the event which will bring together 11 counties in the region will now be held at Kinoru Stadium.

He said the meeting will be preceded by a leaders’ meeting from the 11 counties from the region a day earlier, before their resolutions are read in public.

The county chief further revealed that counties from the region, among them Meru, Tharaka Nithi and Embu had already held their local caucuses and were ready for the inaugural regional BBI meeting.

Other regions expected to make their input are Kirinyaga, Laikipia, Nyeri, Nyandarua, Nakuru, Nairobi, Murang’a and Kiambu counties.

Wanga elders have today warned Luhyas against electing people that crippled Mumias Sugar Company when they had power to save the only economic source in western province.

Speaking at a meeting in shiembekho restaurant in Matungu constituency, Mr. Peter Mumia Shitawa who is the current Nabongo warned Luhyas against electing those leaders that had evidence that would take Kidero to jail for freezing Mumias sugar on the governorship position.

Up to date millions of residents of Mumias youth dropped out of school as they soley depended on Mumias Sugar Company as their main source of income. Mr. Shitawa asked Luhyas not to vote for Ayub Savula and Bonny Khalwale as governor for it will be suicidal to their economy as people will languish in poverty forever.

Lugari MP and Kakamega gubernatorial aspirant in 2022 Ayub Savula who is a former journalist is said to have had massive intensive evidence against Dr. Evans Kidero, the then Mumias sugar company CEO.

The evidence could have seen Kidero’s property repossessed and Mumias sugar reopened.

When Kidero knew the massive evidence against him was going to bring him down, he approached Ayub savula with a bribe totaling to 300 million shillings.

Savula on the other hand rejected the bribe and asked Kidero to show him “how to fish” from the sweat of Luhyas.

This is when Kidero introduced savula to the business of importing cheap sugar from Uganda and repackaging it into Mumias sugar company packets.

The two became millionaires and hence the source of Savula’s massive wealth and intention to become the governor.

On the other hand former Kakamega senator Dr.  Bonny Khalwale tabled massive evidence against Kidero in the senate.

This evidence was enough to impeach Kidero as the governor of Nairobi should he have been found guilty of corruption.

Kidero being a corruption mafia, he summoned the poor beggar khalwale to a hotel in Uganda and offered him a bribe worth 20 million., the money the polygamous khalwale could not reject and ended up selling the Luhya people to the dogs.

Should the people of Kakamega County listen to peter, the second Mumia, then it is obvious that Khalwale and Savula stand no chance of becoming governors of Kakamega county come 2022 and should not waste their finances on the campaigns.

Currently Kakamega County stands as one of the most developed counties after the introduction of devolved system of government.

A Kiambu Member of County Assembly has been found dead.

Reports indicate that Kahawa Wendani MCA Hon Cyrus Omondi has been found dead inside his room in India.

The MCA was in the company of his colleagues at the country for a workshop.

According to the emerging reports, the only Luo MCA in Kiambu who was elected on a Jubilee ticket might have died from a heart attack.

According to Kiambu County Assembly Speaker, Stephen Ndichu, says Omondi died after suffering a heart attack.

Cyrus Omondi, who was on a trip to India, was found dead in his hotel room Wednesday, Witethie ward representative, Julius Macharia has also confirmed.

Macharia alias Taki said Omondi’s death has come as a shock to the Kiambu County Assembly fraternity, given he was of good health at the time of his demise.

“I received news of Omondi’s death via a social media platform that all Kiambu MCAs are on,” said Macharia.

Another MCA from Kiambu County, Simon Kuria Wakarema, who represents Theta Ward, said Omondi was among MCAs in the Education Committee, who attended a workshop in India recently.

Nairobi Governor Mike Sonko was on Wednesday morning ejected from Mzee Daniel Moi’s funeral at Kabarak.

Sonko was ejected from the main dais shortly after arriving.

The embattled governor tried to access the main dais where other dignitaries were sitting.

Sonko had to suffer the humiliation after he was ejected from the VIP dais at the burial ceremony of retired President Daniel arap Moi, at Kabarak University grounds in Nakuru County.

The final journey for the late former head of state is fully under the control of the military.

Sonko in this case, had breached the protocol.

However, in the videos doing rounds on social media, Sonko looks undisturbed.

The body left Wilson Airport, Nairobi at around 7.40am and headed to Kabarak airstrip for his final journey.

Tens of people started streaming into Kabarak University compound at Moi’s Kabarak home as early as 3am where the burial service will take place, with the first 30,000 getting free snacks, a bottle of soda and a loaf of bread.

Heavy commercial vehicles have been kept off the Nairobi-Eldoret Highway.Police officers were lined up along the highway from Nairobi to Kabarak to enable easy movement of vehicles.

Police said the heavy commercial vehicles will be allowed back on the road at 7pm Wednesday.

The former president died on February 4 in Nairobi aged 95, with the family arguing that he was aged 105 instead.

The body of the late former head of state Daniel Moi has arrived in Kabarak ahead of a military burial.

The body left Wilson Airport, Nairobi at around 7.40am and headed to Kabarak airstrip for his final journey.

The body was on Wednesday morning driven in a military car from Lee Funeral Home to Wilson Airport and loaded onto a military transport helicopter.
