Members of Parliament are plotting to exploit a loophole in the Constitution by ‘sitting’ on Ekuru ukot’s Punguza Mizigo Bill should it get the backing of at least 24 county assemblies as required for it to be submitted to Parliament.

Article 257 of the Constitution that provides for the popular initiative path does not give timelines within which Parliament should introduce the Bill, handing lawmakers a lethal weapon against the initiative.

“If a county assembly approves the draft Bill within three months after the date it was submitted by the Commission, the speaker of the county assembly shall deliver a copy of the draft Bill jointly to the speakers of the two Houses of Parliament, with a certificate that the county assembly has approved it.

“If a draft Bill has been approved by a majority of the county assemblies, it shall be introduced in Parliament without delay,” reads the Article.Several MPs disclosed that they may decide to exploit the loophole in a protest against the Ekuru Aukot-led Thirdway Alliance for allegedly not engaging stakeholders in coming up with the Bill.

The Punguza Mizigo Bill, which also proposes a single seven-year presidential term and installs Senate as the upper house, however, was backed by 1.2 million voters — more than the 1 million needed for the electoral commission to submit the draft Bill to county assemblies. 

At the heart of the plot is a bid by MPs to protect President Uhuru Kenyatta and Opposition chief Raila Odinga’s Building Bridges Initiative (BBI), which is expected to come up with a Bill for a referendum.

Raila has expressly asked his supporters to ignore the Punguza Mizigo Bill, and yesterday the Siaya county assembly rejected it after members approved a Justice Committee report that recommended its rejection.

Jubilee, through Secretary General Raphael Tuju, has said the ruling party was for the BBI, giving the strongest indication that the two main parties may use their numerical strengths in both county assemblies and Parliament to frustrate the passage of the Bill.

A sex scandal involving Prophet David Owuor’s former bishop and women in the Repentance and Holiness Ministry has emerged.

Bishop Joseph Gitonga — Owuor’s long-term personal assistant and head of security — has since been expelled from the church.

Gitonga, who was serving as the Bishop of the Kasarani branch, was ex-communicated on Sunday after several women in the church claimed they had been having sex with him.

Gitonga was the second most powerful person in the ministry after Prophet Owuor who is adored by the faithful as ‘the Mightiest Prophet of the Lord’.

He was among the few church top brass who had direct contact with Owuor and served as the link between the prophet and other bishops.

Gitonga managed several church projects and coordinated programmes and events including the crusades the prophet has been having across the country.

“This is an official communication that you Joseph Gitonga are forthwith excommunicated from the glorious Ministry of Repentance and Holiness with immediate effect together with your family and you are not allowed to congregate with this holy ministry of the Lord,” reads a notice authored by senior archbishop John Litunda.

The notice was copied to the National Council of Bishops — the church’s top decision making organ and all pastors.

Lawyer Okongo Omogeni, speaking on behalf of the National Council of Bishops, confirmed the excommunication of Bishop Gitonga.

“There were indecent sinful acts that were taking place within the church that led to his expulsion. There were victims who confessed, that is why the Bishop and the board met to take that action,” he told the Star.

However, several attempts to get a comment from Bishop Gitonga were futile as he did not respond to three messages and several calls to his mobile phone.

The prophet intervened in the matter after some members of the Kasarani church complained to him about  Gitonga’s alleged actions.

During the service, the women narrated how Gitonga had been praying and smearing anointing oil on every part of their bodies including their private parts.

The Star has obtained exclusive audio clips of the women’s confessions during one of the Sunday services.

“ … Akaenda na akaniombea bila nguo. Alinipaka mafuta mwili mzima mpaka sehemeu za siri. Akatoa mwili yake, sehemu yake ya siri… (loosely translated as…..he prayed for me while I was naked. He smeared the anointing oil in my entire body including private parts before lowering his pants….” a woman is heard confessing.

In another clip, a woman who had problems in marriage is heard saying she had sex with Gitonga in his Langata home.

“Nilikua napitia shida kwenye ndoa yangu, nikapigia bishop akaniambia niende kwake, mahali alikuwa anaishi Langata….. bishop akakuja chini usiku kama saa tano akaniambia anataka kuniombea akaniambia nitoe nguo zote akachukua anointing oil akapaka kwa mwili wangu yote nikiwa uchi. (I had marital problems and I called bishop and he told me to visit his home in Lang’ata. He came down at about 11 o’clock and told me to remove my clothes…….” .

On Tuesday, the Star managed to reach one of the women who was only identified as Caro.

She declined to comment on the incident and whether she had reported to the police.

Instead, she asked the Star to speak to the church leadership. “I cannot talk about it right now. Maybe you come [to church] on Sunday. You talk to the higher authority. They will give you the whole information,” she said.

Immediately after the Sunday service, Litunda sent out a notice to all bishops warning them against sharing the confessions with anybody “as the enemy may take advantage of it”.

When reached on Tuesday, Litunda said he was in a meeting and promised to call back. He had not called back by 7pm yesterday despite several phone calls seeking comment.

Three other bishops, who are the members of the National Council of Bishops, declined to comment and referred reporters to senior archbishop Litunda.

Some church members claimed the women could have been coached to lie against Gitonga.

On Wednesday, the Kasarani church had been  brought down under unclear circumstances. When the Star visited the place, the tent had already come down.

Youth and  church members were loading the tents and other equipment into a white canter.

“We have guns, we can shoot you. Try what you want to do you and you see,” a man told the Star photographer at the scene.

Two bishops oversaw the exercise.

Last Sunday, bishops headed by Litunda went to the Kasarani church to instal Erick Simiyu as the new bishop.

Governors have announced to shutdown all counties from September 16 if the Division of Revenue bill impasse is not resolved.

Council of Governors chair Wycliffe Oparanya has on Thursday made the announcement.

Governors in July accused the National Treasury and the National Assembly of holding counties hostage.

The county chiefs said the National Treasury has continuously been ignoring the Commission of Revenue Allocation’s recommendations on the sharing of revenue between the national government and the developed units.

The governors spoke outside the Supreme Court after lodging a case seeking the apex court’s intervention in unlocking the current impasse on the Division of Revenue Bill 2019.

A section of KNUT officials on Thursday stormed the union’s headquarters and demanded the removal of Secretary General, Wilson Sossion.

The situation, which was getting out of hand, had to be managed by the police, who fired teargas canisters the teachers.

The police later tried to calm the situation in the area.

During a press conference held on Wednesday by Sossion, he directed that the union offices would be closed from August 28 to September 23.

He went ahead and postponed KNUT’s NEC meeting that was supposed to be scheduled for Thursday. 

” Within my power as secretary general given by the constitution, I did postpone the NEC meeting,” Sossion stated.

 The KNUT boss also announced that he would only step aside if voted out by delegates.

“I’m not quitting…I’m not quitting…and I cannot be removed. Forget about it, no matter how much money they use, I am not on trial. I will only go home if the delegates say so,” he remarked.

Kibra parliamentary hopeful on the Orange Democratic Movement (ODM) ticket Christone Odhiambo alias Kriss Darlin now says that he is ready to battle it out with anyone.

This comes amid possibilities that the ruling Jubilee Party could as well present a candidate in a bid to snatch the seat which has for years belonged to the Orange party.

Speaking on Wednesday evening, the deejay said that he is ready to battle it out with a Jubilee candidate, daring the President Uhuru Kenyatta-led side to join the race.

Confident of a nomination, in an interview on Radio Jambo’s Mazungumzo Waziwazi, he predicted that the introduction of a Jubilee candidate will make it even easier for him.

“Jubilee fielding a candidate will be even more helpful, they are welcome (Jubilee kuleta mtu itanisaidia zaidi, nawakaribisha),” he said.

On the other hand, he called upon the ODM to hold free and fair nominations, in a party that has repeatedly seen its primaries married with confusion and at times violence.

He declared his readiness to support whoever wins the party ticket, provided that the exercise is credible.

“If we lose in a free and fair way we will accept the outcome and back the winner (Tukishindwa na tuone ni free and fair tutakubali na tumuunge yule ameshinda),” he added.

Raila Odinga’s ODM party has planned to spend Sh10 million to conduct nominations ahead of Kibra parliamentary race.On Wednesday, the nominations that had been scheduled for Saturday 31st were postponed to September 7 over security concerns.

The party Secretary General Edwin Sifuna defended the high budget, saying the money was meant to make the contest free and fair.

“We want to run a free and fair democratic contest. Each of the candidates cleared will be given an equal chance to prove his popularity without any interference,” said Mr Sifuna.

Sifuna also revealed that ODM had handed the names of 11 candidates cleared to run in the primaries to IEBC.

He noted that since the party has been blamed for holding shambolic nominations in the past, a situation that led to an exodus of some of the candidates to other parties, ODM will this time be keen to avoid such a scenario.

“We are not going to entertain chaos. If you try to cause chaos we will de-register you from the party. You must conduct yourselves with utmost civility,” Sifuna told the candidates.

Those cleared are Christone Odhiambo, popularly known as DJ Kriss Darlin, Peter Ochieng, Tony Ogola Sira, William Ayacko and Stephen Okello.

Others are Bernard Otieno, Eric Ochieng, Brian Owino, John Otieno, Benson Musungu and Patrick Lumumba Owade.The by-election will be held on November 7.

The seat fell vacant following the death of Ken Okoth on July 26.Sifuna reiterated party leader Raila Odinga’s remarks that the exercise will be free and fair, and urged candidates to promote party values.

The race for the vacant Kibra parliamentary seat is getting hotter as days continue elapsing. As Raila Odinga-led ODM party continues to await its nominations for them to decide on whom will bear its flag, some parties have already unveiled their candidate.

Musalia Mudavadi’s Amani National Congress (ANC) on Wednesday unveiled former Raila’s aide Eliud Owalo as their candidate in the upcoming by-elections.

Just recently, Owalo ditched ODM for ANC in readiness for the race.

Owalo will face Jubilee and ODM candidates in the November 7, 2019 mini polls.

ODM will unveil its candidate after their nominations that have been scheduled for Saturday 31st.

The ruling Jubilee party will also unveil its candidate once it settles its matters regarding the same. The party through its Secretary General Raphael Tuju on Monday disowned a letter bearing the list of aspirants that had been submitted to IEBC.

It has not submitted another list. The disowned list bore the names of soccer star McDonald Mariga, Morris Peter Kinyanjui, Walter Trenk, Said Ibrahim and Doreen Wasike.

The Kibra MP seat fell vacant following the demise of Ken Okoth who succumbed to cancer in July.

Jubilee’s Youth League President, Gideon Keter, has endorsed soccer star, McDonald Mariga, for the much hyped Kibra MP race.

Through a tweet, Keter has claimed that Mariga is just like any other youth in Kenya and if at all he declares his interest to contest under Jubilee’s ticket, then he has his full blessings.

Keter’s endorsement comes as Mariga is drawn at center of the Jubilee’s infighting. This follows IEBC action to return the letter which Mariga was listed among the five candidates to represent the party in Kibra race.

IEBC was compelled to return the letter after the Party disowned it terming it fake.

But the letter has been strongly defended by Ruto’s camp. Dennis Itumbi,who is a close associate of Ruto, has been sharing several tweets that confirm Mariga is a registered Jubilee member and that he was among the individual picked by the party to vie for Kibra MP seat.

This infighting in the Party has forced Ruto to intervene by blasting Standard Newspaper for propagating rumors meant injure Jubilee’s reputation and escalate the matter.

Former Transport Licencing Board (TLB) chairman Hassan Ole Kamwaro has succumbed to Cancer while receiving treatment in America.

Kamwaro has been suffering from throat cancer – Lymphoma (cancer of the lymphnodes).

His family has confirmed the death. His daughter Jedidah Kamwaro has confirmed.

ODM has submitted to the IEBC the names of 11 out of 20 aspirants for the Kibra MP by-election.

This is after nine failed to comply with the requirements set out by the party.

A total of 23 people had picked application forms for the nomination exercise slated for August 31.

Board chairperson Judith Pareno on Monday told cleared aspirants to pay Sh200,000 fees by midday Tuesday or be locked out of the nomination.

Those cleared include Christone Odhiambo, popularly known as DJ Kris Darlin, Peter Ochieng, Tony Ogola Sira, Reuben Ojijo and Stephen Okello.

Others are Bernard Otieno, Eric Ochieng, Brian Owino, John Otieno, Benson Musungu and Patrick Lumumba Owade.

Elsewhere, Jubilee will field a candidate for the race.

The Kibra constituency by-election is scheduled for  November 7.

The seat fell vacant after the death of Ken Okoth on July 26 after a battle with cancer.

A controversial letter allegedly from the ruling party Jubilee that was released on Monday evening has continued to raise more questions than answers.

The letter which bore the names of Jubilee candidates interested in Kibra by-elections which letter dismissed by the party’s secretary general Raphael Tuju as fake.

However, the Independent Electoral and Boundaries Commission confirmed having received the letter but got concerned about the letter’s dismissal by the party.

IEBC said it had learnt that Jubilee had disowned the letter sent to the commission on August 26.

“It has come to the attention of the Commission that Jubilee Party has denied authoring the said letter and termed it as fake,” said IEBC adding that it had written to the party forwarding a copy of the letter “for the party’s information and further action.”

The names of the candidates in the alleged fake letter are soccer star McDonald Mariga, Morris Peter Kinyanjui, Walter Trenk, Said Ibrahim and Doreen Wasike.

According to an exclusive report by The Standard, Deputy President William Ruto’s camp which favours Mr Mariga’s candidature – sensationally claimed that their rivals in the ruling party, led by Tuju, had hatched a plot to field a weak candidate for the Kibra election in order to help opposition leader Raila Odinga’s ODM candidate win.

The Mariga candidature has caused a debate, with President Uhuru Kenyatta’s wing of the party insisting that it was in charge of party affairs even as it accused Ruto’s side of pushing for Mariga’s candidature through a fake list of candidates published on Monday evening to hoodwink the electorate.

Jubilee’s candidate is expected to face off with Raila’s ODM candidate in the upcoming November 7, 2019 by-elections.

ODM will hold its nominations on Saturday 31st to get the party’s flag bearer in the mini polls.

National Environment Management Authority has closed Sameer Agriculture and Livestock Limited for discharging untreated wastewater straight to the public sewerage.

The company is a milk processing plant, which produces Daima Milk and other dairy products.

Officials from Nema raided the facility which is located in Industrial Area in Nairobi on Tuesday to access its operations.

“We have to close down this facility because they are discharging untreated wastewater bypassing the treatment plant,” Ag. Director General Mamo B.Mamo said.

The company’s Managing Director managed to escape before Nema officials arrived at the scene.

The company’s Cooperation Manager was arrested for discharging untreated effluent into the Nairobi Sewer that results in the pollution of Nairobi River.

Addressing the media after the closure, Mamo said the exercise will continue, putting on notice companies that are discharging untreated waste.

“We want to put all those facilities polluting our rivers on notice that Nema is not going to stand and wait for you to pollute our rivers. We will continue with this exercise and ensure that our rivers are clean,” he added.

Nema said the company failed to follow the Water Regulation Act of 2013 by discharging the waste directly to the river.

The Orange Democratic Movement (ODM) party on Monday cleared 20 candidates who are set to battle in the forthcoming nominations ahead of the Kibra parliamentary by-elections.

The party’s National Elections Board vetted the 20 candidates ordering them to pay a nomination fee of Ksh 250,000 by today(Tuesday) noon.

However, Kenyans on twitter have caused a storm after they argued that one of the contestants in ODM’s nominations scheduled for Saturday 31st August is a renown goon.

Kicking off the debate, controversial blogger Robert Alai asked the party through its official twitter handle if criminals have the right to vie.

On Monday, another controversial blogger, Disembe Dikembe endorsed Brian Shem Owino, whom Kenyans are opposing following his criminal record.

In May last year, Mr Owino was a wanted man by police over an assault case. He was accused of assaulting a Nairobi businessman Timothy Muriuki.

Brian Shem Owino surrendered to police at Nairobi Area DCI hours after he and his accomplices lost a bid to stop their arrest.He was taken in for questioning and possible prosecution.

Nairobi DCI Nicholas Kamwende and his lawyer Edwin Sifuna confirmed Owino’s surrender.

Edwin Sifuna is the ODM secretary general, who on Sunday during the unveiling of the candidates at Kamkunji grounds in Kibera insisted that he was not going to allow any arrogant people to vie.

Owino and his four accomplices had moved to court seeking protection. Sifuna secured his release.

They were captured on camera manhandling the former Nairobi Central Business District Association (NCBDA) chairman at Hotel Boulevard on April 30.

They had moved to court saying their personal security was at risk and that they could be eliminated by the police or deported to an unknown destination on the fake grounds they are not Kenyans and sought anticipatory orders pending their arraignment.

But the court declined to issue the orders and ordered them to appear before police for processing.They said they were ready and willing to surrender to the police but were apprehensive of their personal security and that their anticipated charges were defective, had no basis in law and  were unconstitutional and unsustainable.

Brian Shem Owino will face other candidates in ODM nominations and if he makes it, he will carry the ODM flag and face other party’s candidates who among them are candidates from President Uhuru Kenyatta’s Jubilee and Musalia Mudavadi’s ANC party.

Former Milele FM presented Geoffrey Kwatemba who was kidnapped by unknown people on Saturday has now been released. 

The Machakos County Communication boss thanked all people who were involved in making sure he is released by his abductors. 

“I want to take this opportunity first to thank my creator Jehovah God for his supernatural protection for more than 36 hours in the hands of the enemy, my wife Milly Wandera and my Sons Allan and Barney for being there for me, and my brother’s and sisters, not forgetting my cousin Henry Atetwe and nephew Ben Kwatemba . It was tough but you persevered through it all,” said Kwatemba.

Reports indicate that the Kwatemba was kidnapped by unknown people upon arriving in Nairobi on Saturday after attending the album launch of Gospel Musician Doreen Otipo in West Pokot.

“My thanks to all who cheaped (sic) in a single coin to ensure we pay the amount and all Kenyans at-large for your prayers and standing the gap. Godbless us all,” he added.

 He further thanked Machakos County Governor Alfred Mutua and his colleagues in the media industry for raising alarm over the issue.

Kwatemba, a gospel musician has recorded several songs including Yangula, Omwoyo, Yananga, Yohana, Khwekanile among others.

Raila Odinga-led Orange Democratic Party (ODM) has summoned six Kisumu MCAs for violating party principles and trying to undermine Governor Anyang’ Nyong’o .

The summoned MCAs are to appear before the party’s disciplinary committee on Friday at Kisumu Central ODM party office. 

Those summoned are Majority leader Kenneth Onyango, Chief Whip Gard Olima, the Deputy Speaker Roy Samo, Nominated MCAs Jane Manuche, Nyangoya Oguok and Caleb Omoro.

The summons letter was signed by the secretary of the Disciplinary Committee Paul Otieno, the six are expected to appear before the committee at the Kisumu central ODM party office.

The six are to answer to different allegations and are liberty to be accompanied by their legal counsel.

Samo is accused of convening a press conference and calling Deputy Governor Mathews Owili, an ODM member, a ‘flower girl’ who has not been chairman of a cattle dip.

Olima is accused of failing to whip members to back the county government agenda in the assembly and instead whipping them to jointly oppose the administration agenda.

He has also been accused of convening and participating in a press conference where the top county leadership and senor party members were maligned in public.

“You are invited to appear before the committee on Friday, August 30 at 10.30am to respond to the issues raised,” read the letter copied to the party leader Raila Odinga, secretary general Edwin Sifuna and the Kisumu county ODM chair. 

The nominated MCAs are also accused of not supporting party ideologies and interests in the assembly.

However, some sources claim the summons relates to the impeachment of Finance CEC Nerry Achar, despite party various calls not to impeach officers.

The MCAs had claimed that Achar was failing the county as a whole. She refused to quit.

The summons follows the part’s county delegates conference at Tom Mboya Labour College where various leaders, including the MCAs, were warned against violating the party’s wishes and directives.

The ODM National Elections Board (NEB) has vetted and cleared 20 aspirants for the vacant Kibra seat to take part in the party nomination exercise scheduled for Saturday 31st August 2019.

In a vetting exercise held on Monday, the aspirants have however been given a tight deadline to pay a non-refundable nomination fee of Ksh 250,000.

They have up to today( Tuesday) midday to pay the nomination fee to be eligible for the exercise.

A total of 23 people had picked application forms for the nomination exercise slated for August 31.

Board chairperson Judith Pareno urged cleared aspirants to pay fees by midday Tuesday or be locked out of the nomination.

The nomination exercise will be held in all IEBC registered polling stations in the constituency and only party members will participate.
